Full payment is required within 48 hours of the auction's conclusion. Invoices exceeding $5,000 must be paid via wire transfer unless prior authorization from the auctioneer is obtained. If the auctioneer agrees to accept a credit card payment, a 3% credit card fee will apply. Insufficient funds are not considered a valid excuse for non-payment. If payment is not received within the specified 48-hour period, the bidder authorizes the auctioneer to charge the amount due to any credit card on file. Bidders seeking financing must enter into an agreement outlining complete terms and conditions. **Failure to Pay** If a winning bidder fails to make the required payment within the stipulated timeframe, they consent to forfeit one-third of the total payment due (including any financed amount) as liquidated damages or for specific enforcement, plus 150% of the auctioneer’s legal and collection costs. **Taxes and Fees** Unless specified otherwise, any taxes or fees related to the property are the buyer's responsibility. Properties are sold in 'as is' condition with all faults and defects, and no warranties or guarantees are provided. The auctioneer makes no representations regarding the suitability of any property for a particular use. **Due Diligence** Bidders are responsible for conducting their own due diligence prior to bidding, including verifying the property’s characteristics, suitability for intended use, location, taxes or fees owed, encumbrances, access, mineral rights, availability on street access and water rights. Failure to visit the property constitutes a waiver of any claims. Buyers are encouraged to consult an attorney before bidding. Photos may represent general areas and not the exact property. **Transfer of Ownership** Ownership conveyance is typically not completed through title-insured closing unless requested by the bidder in advance and agreed to by the auctioneer, with associated costs borne by the bidder. The auctioneer may act as the bidder's agent to complete any closing or corrective documents. For each lot, the bidder must provide deed information, including the name and address of the grantee. If the bidder does not specify this information within two weeks of payment, the auctioneer will use the bidder’s registered name and address for the deed. **Credit Card Chargebacks** Bidders agree not to initiate credit card chargebacks under any circumstances. If a chargeback is initiated, the bidder must withdraw it upon the auctioneer's request and cover all associated costs, including legal fees. **Bidder Responsibility** Each bid is an irrevocable offer to purchase the assets in the auction lot. Bidders are responsible for all bids made under their account and bidder number. If a bidder suspects unauthorized use of their account, they must immediately notify the auctioneer at premierproperties02@gmail.com, report the incident to law enforcement, and provide a copy of the police report. Failure to do so will result in the bidder being held personally responsible for all purchases.
