Online Real Estate Terms:
1. The terms and conditions as stated for this auction are part of the offering and by bidding, buyers agree to those terms. No financing or other contingencies.
2. Property is being sold "As Is Where Is" with no warranty written or implied. Property is/was available for inspections prior to the auction, at the open house, or by appointment. All required inspections must be completed prior to bidding.
3. Successful high bidder will be required to sign the contract for purchase and all other required documents within 48 hours of the completion of the auction.
4. A 10% nonrefundable down payment in the form of a cashier's check or wire transfer must be made within 48 hours following the bidding with the balance due at closing within 30 days of auction completion. All wire transfer fees to be paid by buyer.
5. Seller shall deliver at closing a general warranty deed, conveying good and marketable title, free and clear of all liens and encumbrances. Buyers are encouraged to have a title search completed as part of their closing costs. If no title search is completed, Buyer will be required to sign a release as Fouss Real Estate Auctions LLC is not making any representations or warranties as to the quality of the title transfered.
6. 10% Buyers Premium will be added to the final bid to determine the contract purchase price.
7. Agency Disclosure: Fouss Real Estate Auctions LLC is acting as an Auctioneer/Agent/Broker for the Seller only. The system will set the increments of bidding.
8. Ending time is a soft close, meaning the system will extend the time and accept bids until there are no bids in the previous 5 minutes.
9. Announcements made by the auction company from the auction block, on the day of the auction, via email or any other means take precedence over all advertisements and statements previously made.
10. Disclaimer: All information is believed to be correct to the best knowledge of the Auctioneer/Agent/Broker's knowledge but is not warrantied and is subject to inspection and verification by all parties relying on it prior to bidding. All measurements and dimensions are approximate and should be verified before bidding.
11. Sellers/Auctioneer/Agent/Broker shall not be liable for errors, inaccuracies, or omissions.
12. All auctions are with reserve unless otherwise noted.
13. Auction company will not be responsible for accidents, loss, or any disruption in the electronic bidding process, power or internet service potentially effecting the outcome.
14. Failure on the part of the buyer to sign documents or remit payment within the 48 hour period will be considered a default.
15. Any personal property left in the property at the time of closing will become property of the Buyer.
16.Auction Revisions: All aspects of this auction are subject to change without or with limited notice. The Auctioneer reserves the right to, at any time: 1. Add or remove items from the auction, 2. Split or combine lots, 3. Add minimum bids or reserve prices, 4. Cancel, suspend, extend or reschedule the sale of an individual item, lot, part of or an entire auction, 5. Make changes to the auction's closing date or time, inspection, or removal times, 6. Take any other action the Auctioneer deems necessary to effect the fair conduct of this auction or protection of the buyers, sellers or other parties of interest. Auctioneer and staff retain the right to bid and buy at the auction under the same terms and conditions as any other bidder, or 7. Auctioneer reserves the right to wave of enforce any rights.
