1. All items/lots are sold AS IS - WHERE IS AND WITH ALL FAULTS. The seller and auction company do not warrant the authenticity or condition of any items. Descriptive references contained in any document or used by any person in describing the items being sold are used for convenience only. Bidder inspection is STRONGLY encouraged. Bidder acknowledges that all item/lots were available for inspection prior to the auction and by these terms Bidders failure to inspect, or otherwise be fully informed as to the nature, quality, condition, quantity and size of any item/lot will not constitute ground for any claim, adjustment, refund, termination of the contract for sale, or refusal to close the sale against Auctioneer or Owner/Seller. ALL SALES ARE FINAL.
2. A Buyers Premium of 14% will be charged to each lot for all successful online bidders. Payment will be processed at the closing of the auction.
3. All items MUST be picked up during the specified pickup time, no exceptions will be made. Failure to remove items during stated time will result in forfeit of item(s). Buyer's credit card will still be charged the full amount. THE DATE AND TIME BY WHICH ALL MERCHANDISE MUST BE REMOVED FROM THE SALE PREMISES IS POSTED ON AN AUCTION-BY-AUCTION BASIS, ON THE SPECIFIC AUCTION PAGE.
4. Title of each lot passes to the high bidder when the lot is "struck down." Merchandise becomes the full responsibility of the Buyer at time of payment. Thereafter, any loss is the sole responsibility of the purchaser. Items are packed and transported by the purchaser at one's own risk and expense. If any employee or agent of Fleetwood Auction Company shall pack or transport the items, it is fully at the risk and responsibility of the purchaser. Fleetwood Auction Company is not responsible for any loss or damage caused by said employee or agent.
5. Fleetwood Auction Company reserves the right to withdraw any property before the auction.
6. All bids are per lot, as numbered, unless otherwise noted by the auctioneer.
7. ONLINE BIDDING: Bidders are approved for online bidding based on their previous records and information provided by HiBid. Credit card payment information must be entered before approval. Approval is solely at the discretion of Fleetwood Auction Company. We are not aware of any online bids in advance, but only during the time of the auction as they are forwarded to our computer systems. Fleetwood Auction Company will not be responsible for any omissions, errors or slow communications related to online bidding. If an online auction is also available for floor bidders, in the event that an of a tie bid between a floor bidder and an online bidder, the floor bidder will take precedence. The auctioneer's decision in this matter is final.
8. ALL BUYERS will pay Pennsylvania sales tax of 6% unless a valid Tax Exemption Form is on file with Fleetwood Auction Company.
9. Auctioneer reserves the right to reject a registration to bid online, withdraw its permission for you to use online bidding, or terminate an online bidding account, for any reason at any time prior to, during or after a sale.
10. Invoices will be emailed to successful Bidders the next business day after the auction has closed. Any and all applicable taxes will be added to the purchase price of all taxable items.
11. By registering, a Bidder agrees to accept all charges on the card that is authorized for use at registration, and the Bidder waives any and all rights concerning charge-backs or refunds for any items charged to the authorized credit card. You will be suspended or may be permanently banned from the site if you provide false information when registering, such as a false name or fraudulent contact information. You will be permanently banned from the site if you are the successful bidder and you do not honor your auction bid.
12. Bidder accepts responsibility for and agrees to indemnify, defend, and hold harmless each Owner/Seller and Auctioneer and their employees, governing bodies, officers, owners, affiliates, subsidiaries, directors, agents and representatives from and against any and all claims, losses, damages, liabilities, judgment, fees, cost and expenses (including reasonable attorneys' fees and expenses) related to, arising from or associated with Buyer's, Buyer's agents or representatives, use of the Site, included but not limited to personal injuries or property damage incurring on the sale premises or during removal and transport of any auction item/lot.
13. Auctioneer cannot, and will not, be held responsible for any interruptions in service, errors, and/or omissions, caused by and means and does not guarantee continual, uninterrupted or error free service or use of the Site. Bidder acknowledges that this auction is conducted electronically and relies on hardware and software that may malfunction without warning.
14. The Auctioneer, in its sole discretion, may void any sale, temporarily suspend bidding and re-sell any item/lots that were affected by any malfunction. The decision of the Auctioneer is final, binding and conclusive.
15. As a Bidder, placing a bid is a binding contract between you and the Owner/Seller and the bid cannot be retracted. Once you place a bid, and if you win, you will be obligated to purchase the product at the said price you indicated as your bid.
16. Placing a bid on this Site, and winning, then not paying for the product is illegal, and prosecution can result. Any bid can be rejected through this Site at the Owner/Sellers sole discretion. HiBid undertakes the execution of online bidding as a convenience for clients and is not responsible for any inadvertent failure to execute bids, or for any error in the execution of bids.
17. As a Bidder you are responsible for any and all bids placed under your bidding number and password. The security of your Bidder information is your sole responsibility as you, the Bidder, will be held responsible. If at any time you feel as though your bidder number and password have been compromised due to lack of security on your part you must notify the Auctioneer IMMEDIATELY at 610-207-2702.
18. SHIPPING: Shipping is available on select lots only for an extra fee and will be charged separately. Shipping and handling may vary due to size and weight (minimum handling fee: $15.00).
19. PICKUP: You MUST bring a paid invoice with you at the time of pickup. All items must be paid in full prior to pickup. PLEASE NOTE: Bidders are responsible for supplying their own packing supplies; such as bubble wrap, newspaper, packing peanuts, tape, bins, boxes, blankets, so on and so forth. Please keep in mind to have help with you when purchasing something of greater size and weight. All Merchandise must be picked up by the end of business day (5:00 PM EST) for 4 days following the auction. Auctions are scheduled to go live on Wendsdays at 5:00 PM EST and conclude the following Wednesday at 5:00 PM EST. Pickups will start on Thurday after the auction has concluded. Pickup times will be Thursday from 1:00PM - 5:00PM and Friday through Sunday from 11:00AM - 5:00PM.
20. Auctioneers may from time to time make changes to these terms and conditions. Any changes will be posted on the website at http://www.fleetwoodauctioncompany.com . Please make sure to review these terms and conditions regularly to ensure you are aware of any changes made by the Auctioneer. If you use the Site after changes have been made and posted, you shall be deemed to have agreed to such changes. If you do not agree to such changes, you should not make any subsequent use of the Site.
