Terms and Conditions
We ship from in house and use Pirate Ship to get you the best shipping prices! All out of state registrations will automatically ship the next day unless you contact us immediately to make other arrangements.
1. Auction items can be picked up at our location at 108 Widefield Blvd OR they can be shipped. Please see terms and conditions for shipping info. Most importantly, we ship from in-house to save you the most money!
Pickup dates are:
Tuesdays and Saturdays immediately following an auction from 9 am to 3 pm.
2. Lots must be picked up within the dates listed above unless special arrangements are made with the auctioneer. A $5 per day per lot storage fee may apply to any items not picked up in the listed window. This does not apply to items that need to be shipped.
3. A separate shipping invoice will be sent after the initial invoice for items has been paid. This allows us to bundle your wins and get the most accurate shipping costs. If you have any special shipping considerations, please email us.
4. It is your responsibility to read these terms & conditions in full before bidding.
Removal shall be at the sole expense, liability, and risk of the purchaser. If your purchases are not picked up within the pickup window the auctioneer reserves the right to charge a storage fee of $5 per day / per lot. Your items will not be released until the storage fees are paid if your items not picked up within the pickup window. Your items will be held for a maximum of 30 days, after which they will be considered forfeited, and Elevation Auctions may reoffer the items for sale. Forfeited invoices will not be refunded under any circumstances. It is ultimately your responsible to ensure you are available and prepared for the pickup, packaging, and moving of your purchases at the pickup location within the listed pickup window.
There will be no moving assistance for you at the pickup location. You are expected to bring with you all the necessary packing materials and moving assistance required to remove your items. Please do not bid if you cannot make the arrangements to properly move the items you are purchasing. If at any time a member of our staff feels that you are not adequately prepared, or incapable of properly moving an item where we feel there is a risk of damage to our facility, or injury of yourself and others, we will ask you to stop until you can make the proper arrangements to move the items in question. If you cannot get the help required to safely move a large item before the close of the pickup window your items will be forfeited and considered abandoned with no refunds or credit. If during the removal of your purchases from our facility, you damage property in any way you will be required to pay for the damages incurred at your sole expense.
SHIPPING -
PLEASE NOTE! We ship all items from in house.
SHIPPING IS EXPENSIVE, we have NO control over the shipping quotes given by Pirate Ship. It is advised that you call or email the shipper BEFORE bidding to find out the shipping costs on an item BEFORE you bid. A charge of $3-$8 will apply to each package sent for handling and shipping supplies.
Any items left unclaimed, unpaid, or unshipped after 30 days will be considered abandoned and a refund will not be issued. We will reach out by email and phone, and after a final notice is sent after 14 days we will not contact your any further.
PAYMENT:
All invoices must be paid in full no later than 5 days after the close of the auction. Invoices for successful bidders will be sent out no later than the following morning after the close of an auction.
If we have a Credit card on file for you, it will be automatically billed after the close of the auction. We do not accept payments in person, or via cash or check unless previous arrangements have been made. If you need to use a different card than the one you registered with you will need to call us as soon as possible. For payments taken over the phone your billing address registered to your account must match the card you are providing over the phone with no exceptions. Any invoice greater than $5,000 usd payment must be made by a bank wire. Contact us for wire instructions.
For purchases of Gold & Silver: If you are purchasing gold or silver in our auction, we may require additional verification from you prior to your receipt of the items. For purchases of gold or silver more than $100 payments may be required to be made via bank wire. Due to an increased number of fraudulent accounts all new customers must adhere to this rule. Customers who have purchased from 3 or more of our auctions without incident may pay for gold & silver purchases normally with their card.
If you do not pay fully pay an invoice, we reserve the right to seek payment through a legal process such as small claims courts.
BUYER'S PREMIUM
A buyer's premium of 13% will be added to the final price of each item. Sales tax is then applied to the invoice total unless a valid resale certificate is already on file. It is ultimately your responsibility to provide us with a copy of your certificate. The buyer's premium is non-refundable under any circumstances.
WARRANTIES:
Condition reports are made to the best of our ability but are not guarantees. No employee is authorized to make any warranties, expressed or implied, on behalf of Elevation Auctions, LLC. Items described as "Appears to", "possibly", "probably" or "attributed to" are not to be considered a guarantee, but rather the matter of opinion of the auctioneer. No guarantee is made in relation to an items condition. All bids are binding, and you (The seller) are expected to have reviewed the listing and photos for accuracy, lot contents and condition. Once you place a bid on any item in the auction there will be refunds, returns, or exchanges. All items are sold AS IS, WHERE IS as seen in our photos and ALL SALES ARE FINAL. Once a bid is won it is ultimately the buyer's responsibility to gain possession of their purchases regardless of the situation or any previous arrangements made with the auctioneer. In any situation where a purchase is canceled or merchandise is returned by the buyer; shipping costs, fees, and the buyer's premium are non-refundable.
AUCTIONEER'S DETERMINATION:
A lot will be sold to the highest bidder as determined at the auctioneer's sole discretion. The auctioneer will also have the sole discretion to resolve any disputes between bidders and determine whether to pass or re-offer a lot for sale. The auctioneer may reject or challenge any bid or advance in the bidding.
WITHDRAWAL OF PROPERTY
Elevation Auctions, LLC reserves the right to withdraw property from the sale for any reason and with no liability for such withdrawal.
RESCISSION BY PURCHASER
If within thirty (30) days after the sale the original purchaser gives written notice to Elevation Auctions alleging that the age, authenticity, condition, genuineness, quantity, period, culture, source, or origin as set forth in the terms of sale and warranted by Elevation Auctions, as evidenced in the written condition report obtained by the purchaser, were materially inaccurate and misleading and substantially overstated the value of the Property, and returns the Property with five (5) days of receiving this permission in the same condition it was in at the time of sale and proves the truth of such allegations to the satisfaction of Elevation Auctions, the sale of such lot will be rescinded, Elevation Auctions will refund the full purchase price to the purchaser. Refunds shall not include costs of transportation or shipping, insurance, or other expenses that may have been incurred by the purchaser. After 30 days from the date of purchase (NOT the date of delivery) the guarantee will expire and all items are then sold as-is, where-is and there will be no returns for any reason. This limited right of rescission is available only to the original purchaser and may not be relied upon by any heir, agent, transferee, assign, or other third party or assigned to any subsequent transferee of the Property which gives rise to the claim. The purchaser acknowledges and expressly agrees that the provisions of this paragraph state the sole and exclusive remedy available to a purchaser in the event of nonconformity in Property purchased. The purchaser understands and agrees that the exclusive remedy for any breach of the warranty shall be a rescission of the sale and a refund of the original purchase price (bid plus buyer's premium), as well as any applicable taxes paid. Neither Elevation Auctions nor its consignor shall be liable for damages beyond the remedy expressly provided for herein, such as but not limited to, direct, indirect, special, incidental, punitive, or consequential, including the loss of profit or revenue, cost of obtaining alternative property, claims of customers of the purchaser or otherwise.

Pickup dates are:

If you cannot make one of these times for pick-up, please notify us as soon as possible to make special arrangements.
When you win items that must be shipped, we will charge the initial purchase cost to the credit card that's on file. We will then carefully pack your wins and get exact shipping amounts from the most reasonable shipper to the address you have provided in your profile. A separate invoice will be created for the shipping costs of your items. Once this has been paid, these items will be shipped. A charge of $3-$9 will apply to each package sent for handling and shipping supplies.
We do not control shipping costs and we use PirateShip to establish the most reasonable carrier and price for shipping. If you need expedited shipping or any special instructions, please contact us before shipping.
