Terms of Sheriff Auction: Auctioneer is authorized to charge and retain a buyer premium of ten percent (10%) of the bid amount from the highest third party bidder (the “Buyer Premium”). Said Buyer Premium will be paid by the highest third party bidder, to the Auctioneer, and shall be in addition to the amount of the winning bid entered by the highest third party bidder. Bidding shall be made without conditions and with no contingencies of any kind. The Property shall be sold “AS IS AND WHERE IS” with no representations or warranties of any kind being made to the buyer. Auctioneer shall not be held to answer to any claims whatsoever concerning the condition and/or title to the Property. Auctioneer shall require all third party bidders to provide proof of funds prior to being able to bid at the foreclose sale. After conclusion of the auction, if a third party bidder was the winning bidder, such third party shall by 4PM Eastern standard time on the date of the sale deliver to Auctioneer funds in the amount of the bid price, plus the Buyer Premium, which shall be paid by wire transfer. Plaintiff attorney shall facilitate the following to finalize the transfer of the Property: (a.) The Sheriff’s costs and expenses for the sale are paid out of the proceeds of the sale; (b.) A Clerk’s Return is prepared for delivery to the Sheriff; (c.) A Sheriff’s Deed and Sales Disclosure Form for the Property is delivered by the Sheriff or designated deputy to the buyer; (d.) The Sheriff’s Deed, along with fees and other such documents, as may be required by the Recorder and/or other officials of Howard County, Indiana (“County”) are provided by Plaintiff attorney so that the Sheriff’s Deed will be recorded in the public record; and (e.) The net proceeds of the sale are remitted by Auctioneer to Plaintiff in accordance with the Clerk’s Return, which shall account for the gross purchase price less any amounts due to Auctioneer, including the Buyer Premium, sheriff fee, recording costs and auditor fees. Payment to the Auctioneer for its expenses and commissions shall be made prior to the payment of any other item, fee, or expense. The buyer shall be responsible for the payment of all taxes and assessments for installments, which become due and payable after the date of the auction. The property is being sold with no warranties expressed or implied by Krueckeberg Auction Company, Plaintiff or the Seller. Each potential bidder is responsible for conducting his or her own inspections, inquiries, and due diligence concerning this property.
