Eligibility
By using our services, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding contract.
Registration
Some of our services may require you to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
Accuracy of Information
You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
Auctions
Auction Terms
All auctions conducted by South Dakota Land And Auctions LLC are subject to specific terms and conditions which will be provided prior to each auction. Participation in any auction constitutes acceptance of these terms.
Bidding
Bidders are required to comply with all auction rules and regulations. All bids are binding and cannot be withdrawn once placed.
Payments
At the completion of the auction cards on file will be ran for total amount. If card is declined we will reach out to you. Any accounts that are not paid withing 48hours of auction close items will be forfeited and you will be banned from bidding on any of our Auctions in the Future.
Shipping charges will be billed after the items are all boxed up. Usually within 2-7 business days
Property Listings
Accuracy of Listings
While we strive to provide accurate and up-to-date information, we do not warrant that property descriptions or other content on our website are accurate, complete, reliable, current, or error-free.
Due Diligence
Clients are encouraged to conduct their own due diligence before purchasing any property listed on our website and we strongly encourage you to schedule a viewing of items before bidding. All items are as is where is no warranty expressed or implied.
Shipping and Handling
When registering please let me know that you want your items shipped.
Shipping is available for certain items. Shipping will be charged to card on File. If you are from out of state we assume that you want shipping and will box your items up and bill out. Buyers are responsible for all shipping cost and labor to ship items.
Limitation of Liability
South Dakota Land And Auctions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use our services; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from our services; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services by any third party; or (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the services.
Governing Law
These terms and conditions are governed by and construed in accordance with the laws of South Dakota. You agree to submit to the exclusive jurisdiction of the courts located in South Dakota for the resolution of any disputes.
Changes to Terms and Conditions
South Dakota Land And Auctions LLC reserves the right to modify these terms and conditions at any time. Any changes will be posted on this page, and your continued use of our services after such changes have been made constitutes acceptance of the new terms and conditions.
Failure to Pick Up Items
All items not picked up during designated time will be forfeited. If you cannot make it please make arrangements for shipping or storage of these items. We can work with most situations we just need to plan before thanks.
Buyers Premium of 15% on all items
