PMT Auctions and Liquidations - Terms and Conditions Effective Date: 12/1/2024 These Terms and Conditions ("Agreement") govern your participation in online auctions hosted by PMT Auctions and Liquidations on HiBid.com ("HiBid," "Platform"). By registering, bidding, or engaging with any of our auctions, you agree to comply with and be bound by these Terms and Conditions. 1. Eligibility You must be at least 18 years of age and legally capable of entering into binding contracts to participate in PMT Auctions and Liquidations. By participating in our auctions, you confirm that you meet these eligibility requirements. 2. Registration To participate in our auctions on HiBid, you must create an account on the HiBid platform. You agree to provide accurate, current, and complete information when registering and to update your information if necessary. You are responsible for keeping your account details confidential, including your password, and for all activities that occur under your account. 3. Auction Terms Bidding Process: All bids are placed in USD (unless otherwise stated) and are considered final once submitted. By placing a bid, you agree to purchase the item at the winning bid price, plus any applicable taxes, fees, buyer's premium, and shipping costs. Reserve Prices and Minimum Bids: Some items may have reserve prices or minimum bids. If these amounts are not met, the item may not be sold. Auction Timing: Each auction will have specific start and end times, which will be displayed on the website. PMT Auctions and Liquidations reserves the right to extend or cancel an auction at any time without notice. All bids are final! There is no way to reverse a bid once it has been placed! By placing a bid, you are entering into a binding purchase contract, so place bids carefully! 4. Payment Accepted Payment Methods: Payments for auction items will be processed immediately following the close of the auction with the credit card you used to register. Agreement to these terms and conditions authorizes PMT Auctions and Liquidations to process payment using the credit card on file for your total invoice amount including any taxes, fees, or buyers premium. Failure to Pay: If payment is not able to be processed with the credit card you used to register for the auction, PMT Auctions and Liquidations reserves the right to cancel the transaction, and you may be banned from participating in future auctions. Taxes and Fees: All applicable sales tax, buyers premium, or other auction fees are your responsibility and will be added to the final bid amount. The final price includes the winning bid amount, taxes, buyer's premium, and shipping fees(if applicable.) 5. Auction Pickup, Shipping, and Delivery Shipping Costs: Shipping costs are calculated separately and depend on the item and your location. These charges will be outlined at checkout on a per lot basis. Shipping Responsibility: PMT Auctions and Liquidations is not responsible for any damage, loss, or delay that occurs during shipping. You may contact the carrier directly for claims. International Shipping: For international bidders, additional duties, taxes, or customs fees may apply, and you are responsible for these charges. Auction Pickup: It is the sole responsibility of the winning bidder to pick up their items during the designated pickup window(s) Failure To Pickup During Designated times: By agreeing to these terms and conditions, you are agreeing for your card on file to be charged and no refunds to be given whether you pick your items up or not. If you do not pick up your auction items or contact us to make other arrangements, your card will still be charged and you will not receive your items. Invoices must be paid in FULL before you can remove any of the items in which you purchased Item Removal: Buyers are solely responsible for the removal of their items in a safe manner. PMT Auctions and Liquidations is not responsible for the removal of any item. It is the sole responsibility of the buyer to bring any necessary tools or labor required to remove items from the auction pick up site. 6. Auction Items Condition of Items: All items are sold as-is, without any warranty or guarantee. PMT Auctions and Liquidations makes no representations or warranties regarding the condition of any auctioned item unless explicitly stated in the auction listing. Item Descriptions: We strive for accuracy in item descriptions, but it is your responsibility to inspect items before bidding. If you have any questions or need more information about an item, please contact us before placing a bid. All bids are final and cannot be undone once they are placed. 7. Cancellations and Returns No Cancellations: Once a bid is placed and accepted, it cannot be canceled. Please ensure that you want the item before placing a bid. Returns: Unless otherwise specified, PMT Auctions and Liquidations does not accept returns. All sales are final, and it is your responsibility to thoroughly review all items before bidding. 8. User Conduct You agree to: Use the PMT Auctions and Liquidations platform in a lawful manner and follow all applicable laws and regulations. Not engage in any fraudulent or malicious activities, including but not limited to placing false bids, attempting to manipulate auctions, or attempting to hack the platform. 9. Limitation of Liability PMT Auctions and Liquidations is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use our platform, participation in auctions, or the purchase of any items. PMT Auctions and Liquidations is not responsible for any injuries, accidents, or damages that occur during item removal. The buyer assumes any and all risk of removing items from the auction pickup site. 10. Intellectual Property All content on the PMT Auctions and Liquidations website, including text, images, logos, and auction listings, are the property of PMT Auctions and Liquidations and are protected by copyright and trademark laws. You may not use any of this content without prior written permission. 11. Changes to Terms and Conditions PMT Auctions and Liquidations reserves the right to modify or update these Terms and Conditions at any time. Any changes will be posted on this page, and the revised terms will be effective immediately upon posting. It is your responsibility to review these Terms and Conditions regularly. 12. Governing Law This Agreement will be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles. Any disputes arising under or in connection with this Agreement will be resolved in the courts located in appropriate jurisdiction in Missouri. 13.
