These Bidder Terms and Conditions apply to auctions conducted by ROWE REALTY AND APPRAISAL, INC. DBA ROWE REALTY AUCTIONS AND APPRAISAL (“Auctioneer”), and constitute a legal, valid, binding, and enforceable contract between Auctioneer and YOU. These Bidder Terms and Conditions also form the basis for the contract of sale between YOU and the Seller if YOU are the Winning Bidder on any Lot(s). The Buyer’s Premium for the Personal Property included in this auction will be amount equal to TWENTY Percent (20%) of the Hammer Price for Each Lot Struck off at the Auction PLUS an Additional 3.9% Credit Card Processing Fee For use of Credit Card. Please be sure to register in the name of the gun buyer if purchasing a Firearm or Ammunition. PAYMENT: ** Invoices WILL be emailed after the auction, CREDIT CARD, PAYPAL, CERTIFIED CHECK OR Cash Payment is available. NOTE: Buyers premium is 20% regardless of payment type. NEW: Effective Sept. 13th, 2023 prior to transfer of ammunition or firearms including: rifle, shotgun, handguns or pistols to a purchaser you MUST go through NYS to complete the background check process. Cost of the background check is as follows and to be paid BY THE PURCHASER: ** $9.00 per firearm transaction ** 2.50 per ammunition transaction If you purchase a firearm and ammunition on one invoice you will be charged $11.50. * These charges will be added on your invoice as a line item for NYS Buyers ONLY and are NONREFUNDABLE. * If you are an out-of-state buyer who is picking up a firearm or ammunition you MUST have CASH for the NYS NICS fees All paperwork for firearms will be done on site at no extra cost. * If you purchase a handgun that needs to be added to your pistol permit, PLEASE contact your county for information. You can print out the paid invoice we email you and bring it to your pistol permit office. They will add the handgun to your permit and issue you a purchase coupon for your handgun. You will then come to pick up your handgun at Rowe Realty Auctions & Appraisal at your scheduled pick up time. Be sure to bring NYS pistol permit, receipt, and purchase coupon. * If Your county requires extra paperwork, you must REQUEST your counties paperwork from us by EMAIL, with your full name and we will email it back to you, this request must be made with at least 24 hours prior to your scheduled County Appointment, you cannot call us while at the county and expect this paperwork to be sent over immediately. * NOTE: New York State law requires that a National Instant Criminal Background Check must be completed prior to all firearm or ammunitions sales or transfers, including sales or transfers of rifles, shotguns or ammo. The sale or transfer of a firearm, rifle, shotgun or ammunitions at an auction without first conducting a Background Check is a crime. PICK UP INFORMATION: * You agree to pick up dates and times per “Removal Times”, Please be aware of pick up instructions. * ALL Purchases require an appointment for pick up. * If your county requires special paperwork (ex. Genesee or Monroe), please send an email requesting the required paperwork * If Your county requires extra paperwork, you must REQUEST your counties paperwork from us by EMAIL, with your full name and we will email it back to you, this request must be made with at least 24 hours prior to your scheduled County Appointment, you cannot call us while at the county and expect this paperwork to be sent over immediately. * If you are purchasing any firearm please be sure you are buying it under YOUR NAME. No one else can BUY OR PICK UP a firearm, ONLY the purchaser and individual the background check was performed on. Rowe Realty Auctions & Appraisal is an FFL and NYS DEALER. * Each county may have different hours/instructions. We realize many cannot pick up the week after auction; simply make an appointment by email or when you receive your purchase coupon. All firearm purchases require a Federal Background Check (NICS Check) unless you have a Federal Firearms License. All pistols require a NYS pistol permit unless you have a federal firearms license. Some firearms are not NYS compliant. Read the descriptions prior to bidding. SHIPPING: If you purchase ammo and are a NYS buyer, please see instructions below. All shipping costs are the responsibility of the buyer. We do our very best as we have a small staff, which also helps keep your costs down. * WE DO NOT SHIP INTERNATIONALLY ** Firearms Shipping: Please have your FFL email us a copy of their license for shipment. Be sure that they include YOUR NAME or if you are a C&R, please email us a copy of your license. When we receive the FFL/C&R we will begin to pack your items. All postage, insurance and handling fee will be added to EACH shipment for firearms. ** Ammunition Shipping: NYS RESIDENTS: All ammunition must be shipped to an FFL. For all out of state buyers, we will follow any federal regulations for shipping and Ammo is shipped via UPS due to restrictions with USPS Auction Conducted Under and In Accordance with These Bidder Terms and Conditions, Additional Terms and Conditions Posted by Auctioneer, and Announcements Made at the Time of the Auction, and Applicable Law. The Auction is conducted under and in accordance with these Bidder Terms and Conditions, any and all other Terms and Conditions posted by Auctioneer (whether at the Auction Site or online), any announcements or corrections made by Auctioneer at the time of the Auction, and applicable law. By participating in the Auction, whether at the auction site, online, telephonically, or though any other means (including Absentee Bid), YOU agree to be bound by, and to abide by, all such Bidder Terms and Conditions. Buyer's Premium. Each Lot exposed for sale the Auction is subject to a Buyer's Premium, which will be paid by the Buyer to Auctioneer for Auctioneer's own account. The Buyer's Premium is earned by Auctioneer with the Fall of the Hammer and is non-refundable. The Buyer's Premium will be added to the Hammer Price to determine the final Contract Price for tax purposes. If YOU are the Winning Bidder on any Lot(s) and YOU default on YOUR obligations as set forth in these Bidder Terms and Conditions, there will be no set-off or reduction in the Buyer's Premium even if a Lot is resold. Because the Buyer's Premium is earned with the Fall of the Hammer, Auctioneer has no obligation to mitigate damages with respect to the Buyer's Premium, and YOU acknowledge and agree that mitigation of damages is not possible. Bidding. YOU may only bid at the Auction by agreeing to be bound by these Bidder Terms and Conditions. By bidding, YOU acknowledge and agree that YOU are subject to, and bound by, these Bidder Terms and Conditions. No Bid Retraction. YOU may not retract a bid that has been acknowledged by Auctioneer or that has been submitted online. YOU acknowledge and agree that Auctioneer is acting in reliance on tendered bids in the conduct of the Auction, and that bid retraction is disruptive and interferes with the Auction, and that, as an inducement for Auctioneer to accept YOUR Bidder Registration and for YOU to bid at the Auction, YOU agree not to withdraw or to attempt to withdraw any tendered bid by YOU or on your behalf. Auto Extend Feature. Any Online Bidding Period may include an auto extend feature. This means that, if an online bid is entered within a set time period approaching the end of the established Online Bidding Period, the Online Bidding Period will automatically be extended for an additional amount of time in increments established by Auctioneer, and will continue to be so extended until there is a set period of time that lapses during which no online bids are received, after which bidding will close. Bid Increments. Bid increments are established and controlled by Auctioneer, and may be adjusted or modified in Auctioneer’s sole and absolute discretion. All Property Sold “AS IS”, “WHERE IS”, and “WITH ALL FAULTS”. ALL PROPERTY IS BEING OFFERED AND SOLD IN ITS AS IS/WHERE IS CONDITION AT THE TIME OF THE AUCTION, WITH ALL FAULTS, INCLUDING ANY HIDDEN DEFECTS OF ANY NATURE. Description of Lots. Unless otherwise expressly stated in writing, any description of a Lot is based solely on visual impression, and is given solely for identification purposes, and does not create any warranty, expressed or implied, or representation by Auctioneer or Seller. Motor Vehicles and Equipment. All motor vehicles and motorized equipment (including without being limited to, automobiles, trucks, vans, recreational vehicles, motorcycles. Motor scooted, tractors, earth moving equipment and other heavy equipment) must be paid in full prior to removal from the Auction Site; and if any vehicle or equipment is paid for with a check the vehicle or equipment will not be released unless and until the check clears the drawee banks and the funds have been received by Auctioneer. Title. If YOU are certified as the Winning Bidder on a Lot, YOU will be contractually obligated to pay the Contract Price; however, title and ownership of the Lot will not pass from the Seller to YOU until payment is made and clears. Failure to Pay. If you fail to pay for your purchase(s) within time provided, YOU will be deemed to have abandoned any interest in the Lot(s), but YOU will remain liable for payment of the Contract Price. Unpaid Lot(s) may be retained by Seller, resold at a subsequent auction, or otherwise disposed of. If unpaid Lot(s) are sold at a subsequent auction, YOU will be liable for any shortfall or deficiency on the resale of the Lot(s), plus the costs incurred in connection with reselling the Lot(s). Under no circumstances will YOU be entitled to any surplus from the resale of any unpaid Lot(s). Auctioneer and/or Seller may, at any time, commence a lawsuit against YOU for the Contract Price of any unpaid Lot(s) and/or for any deficiency realized on the resale of such Lot(s). Subject to applicable law, beginning Ten (10) days after the Auction, and continuing until the removal or other disposition of any Lot(s) not been picked-up or removed, a storage charge in the amount of Thirty Dollars ($30) per day will accrue, and Auctioneer will have a possessory lien against such Lot(s) that may be executed on in order to satisfy such storage charges. Claims. After a Lot has been removed from the Auction Site by YOU, or on YOUR behalf, no claims or returns will be allowed and no claim will be allowed for adjustments or rescission of any sales based on the failure of a Lot to correspond with any standard and/or expectation. Private Sale. YOU agree NOT to enter into, or to agree to enter into, a Private Sale for the purchase of any property included, or scheduled to be included in, the Auction, prior to or during the Auction. If YOU purchase any property included in, or scheduled to be included in, the Auction in a Private Sale prior to, or during, or within ten (10) days after the Auction, Auctioneer will be entitled to receive an amount equal to Auctioneer’s full Commission and Buyer’s Premium, and YOU and Seller will be jointly and severally responsible for the payment of such amount. Acceptance of Bidder Terms and Conditions. YOU acknowledge and agree that YOU have had a full and fair opportunity to review these Bidder Terms and Conditions, and that you have read these Bidder Terms and Conditions, you understand these Bidder Terms and Conditions, and you accept and agree to be bound by these Bidder Terms and Conditions. All Sales Final. ALL SALES ARE FINAL. NO REFUNDS OR RETURNS.

Payment Terms
Payment due within 24 hours of receipt of invoice. Acceptable forms of payment include: Cash, Credit Card, PayPal and Bank Checks. Failure to Pay. If you fail to pay for your purchase(s) within time provided, YOU will be deemed to have abandoned any interest in the Lot(s), but YOU will remain liable for payment of the Contract Price. Unpaid Lot(s) may be retained by Seller, resold at a subsequent auction, or otherwise disposed of. If unpaid Lot(s) are sold at a subsequent auction, YOU will be liable for any shortfall or deficiency on the resale of the Lot(s), plus the costs incurred in connection with reselling the Lot(s). Under no circumstances will YOU be entitled to any surplus from the resale of any unpaid Lot(s). Auctioneer and/or Seller may, at any time, commence a lawsuit against YOU for the Contract Price of any unpaid Lot(s) and/or for any deficiency realized on the resale of such Lot(s). Subject to applicable law, beginning Ten (10) days after the Auction, and continuing until the removal or other disposition of any Lot(s) not been picked-up or removed, a storage charge in the amount of Thirty Dollars ($30) per day will accrue, and Auctioneer will have a possessory lien against such Lot(s) that may be executed on in order to satisfy such storage charges. No Stop Payment Orders or Credit Card Chargebacks. YOU agree that YOU will not, under any circumstances, (i) issue a stop payment order with respect to any checks issued at or in connection with the Auction, or (ii) initiate a credit card chargeback with respect to any purchases at the Auction. YOU further agree that if, in violation of these Terms and Conditions, a stop payment order is issued or a credit card chargeback is initiated, these Bidder Terms and Conditions will be conclusive evidence of YOUR (i) waiver of any rights to issue a stop payment order or to initiate a credit card chargeback, and agreement not to issue a stop payment order or to initiate a credit card chargeback; and YOU acknowledge and agree that on Auctioneer’s presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution against which a check was drawn or that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse any stop-payment order and/or reverse or deny any credit card chargeback, and will re-credit all amounts to or for the account of Auctioneer. If, in violation of these Bidder Terms and Conditions, YOU issue a stop payment order or initiate a credit card chargeback, YOU will remain liable for all purchases made at the Auction, and YOU will be responsible for all costs and expenses, including attorneys’ fees, incurred by or on behalf of Auctioneer and/ or Seller in challenging the stop payment order or credit card chargeback and/or in collecting payment. YOU acknowledge and agree that the covenant not to issue a stop payment order or to initiate a credit card chargeback is a condition to the issuance of a Bidder Number or Bidder Account to YOU, and is being made as an inducement for Auctioneer to accept YOUR Bidder Registration, to issue a Bidder Number or Bidder Account to YOU, and to permit YOU to bid at the Auction. YOU acknowledge and agree that Auctioneer is relying on the covenant not to issue a stop payment order or to initiate a credit card chargeback in accepting YOUR Bidder Registration, in issuing a Bidder Number or Bidder Account, and in permitting YOU to bid at the Auction.
