AUCTION TERMS
1. Successful bidder will sign a standard Offer to Purchase form immediately following the auction. Offer will be a cash offer with no contingencies of any kind.
2. Earnest money shall be $20,000 per parcel and will be collected immediately following the auction. If the high bid is accepted, the earnest money will be applied toward the purchase price. If the bid is not accepted, the earnest money will be returned to the buyer.
3. The offer is subject to approval of the Trustee, who will have until February 12, 2025 to accept, reject, or counter today's high bid.
4. This offer may not be rescinded prior to Midnight of February 12, 2025.
5. In the event of a counter-offer, today's high bidder will be given the first opportunity to accept any counter offer.
6. The property is being sold by a trustee whom has never occupied the property. Therefore, a Real Estate Condition Report is not required and will not be provided. The buyer is purchasing the property in its "AS IS" condition. No warranties are made as to the electrical systems, mechanical systems, structural soundness, well, septic system or any other aspects or uses regarding the property. Buyers shall rely entirely on their own inspections of the property and the records.
7. If the offer is accepted, closing will take place on or before March 28, 2025.
8. Real estate taxes will be prorated at the time of closing based on the 2024 taxes.
9. Parcels 1, 2, 4, & 5 will be surveyed. Parcel 3 will be sold by the tax deeded acreage of 30 acres. Parcels 1, 2, 3, & 4 will be by sold bidder's choice, so much per acre, parcel 5 will be sold by the dollar.
10. Tillable acreages were derived from FSA maps but are not guaranteed.
11. A preliminary title policy has been provided by Wisconsin River Title and is available for review prior to the auction. Buyers are accepting the title policy as it reads.
12. If parcel #1 sells separate from Parcel #2 the buyer of parcel #1 will be responsible for applying for and construction of a new driveway for access.
13. There are old dump sites on parcel #4, including an abandoned town dump site. The seller will not be cleaning them up, the buyer accepts them as is.
14. There will be a PRD easement on parcel #4, the balance of tax parcel 0623 & 0624 will not be buildable.
