The bidder acknowledges that all sales are final and All Items "Sell As Is" Shafer Auction is providing internet online bidding as a service to the Bidder. Bidder acknowledges and understands that this service and "The Internet" may or may not function correctly on the days of the auction. Under no circumstances shall the Bidder have any kind of claim against Shafer Auction or anyone else, if the internet service fails to work correctly before or during the Auction. Shafer Auction will not be responsible for any missed bids from any source. Shafer Auction reserves the right to withdraw or re-catalog items in this auction. The value of any Sold Auction Lot which is deemed "Undeliverable" , (Where the auctioneer is unable to deliver a sold lot to the buyer for any reason), is limited to and will not exceed the bid price and buyer fee paid for the auction Lot The bidder acknowledges that Shafer Auction Co. Ltd. Is acting as agent for the seller and all items sold at the auction sale are sold on an "as is , where is" basis. " No" warranty or guarantee is offered or implied as to the condition or fitness for any specific use . It is the sole responsibility of the bidder to inspect their intended purchases where preview time is provided. Any description of merchandise offered by the auctioneer is intended merely as a guide to bidders and may or may not be accurate. Unless otherwise stated all lot photos are of the actual item being sold. REGISTRATION & IDENTIFICATION: All bidders must be of legal age to bid. All bids posted by the bidder are legal and binding. At the time of registration, we collect information about you to verify who you are before you can bid. We collect credit card information to ensure that you are a qualified buyer. Your purchases will be billed to this Credit Card at the conclusion of the auction sale. Registration is a 2 part process, bidders must register first to the HiBid system and additionally register to each particular Auction Sale. PAYING FOR YOUR PURCHASES: There is no cost to Login for an auction (Up to $1 may be charged to validate your card by Auctionflex the first time you register). Your credit card will immediately be charged for purchases at the conclusion of the Auction Sale. When an auction closes, if you are the winner of any auction lots, we will charge your credit card with the winning bid amount, plus applicable Buyers Premium and taxes. CONDITION OF ITEMS SOLD & OUR ONLINE CATALOGUE: Our best efforts are made to represent all items accurately in descriptions and photographs; however, all items are ultimately sold on an "as is, where is" basis, with all faults. We strongly encourage all bidders to personally verify the condition of each item during the scheduled preview times where provided unless otherwise stated all lot photos are of the actual item being sold. No responsibility is assumed by Shafer Auction Co. Ltd. or the seller for any errors or omissions. PICKUPS & REMOVALS: Dates and times for pickup will be posted on our website. Do not bid if you are unable to have your items picked up during the specified time. Any item not picked up during the posted pickup times will be considered an abandoned item. If you abandon an item, your credit card will still be charged for the invoice amount of the item(s). REMOVAL: All items are sold in place. Where applicable, Buyers are responsible to remove items in a good workmanlike manner. Any plumbing must be shut off before being disconnected and any electrical that is disconnected must be capped. You must bring any and all tools, equipment, packaging and labour required to disconnect and remove any items you purchase. We will only have security onsite that will not assist in any way with removal. Please plan ahead and come prepared. Any items not removed by the times shown will be deemed abandoned regardless of the price. WINNING NOTIFICATION & INVOICING: All winning bidders will receive an e-mail notification within 24 hours of the auction closing. All winning invoices will automatically be charged to the credit card supplied by the buyer . BIDDING NOTIFICATIONS: You can choose to be notified by e-mail during the auction if you have been outbid. Please note that outbid notifications are NOT sent out during the last two hours. REVIEWING YOUR BIDS: During an auction you can check the status of your bids at any time. Note that no bids can be withdrawn for any reason. All bids are legally binding and enforceable in Ontario, Canada. CLAIMS: No claims regarding goods purchased will be allowed. Bidders are reminded that all goods are sold on an "as is, where is" basis, with all faults. ADDITIONS & DELETIONS: We reserve the right to remove and/or add lots and/or items to the sale at any point during the auction. PERSONAL & PROPERTY RISKS: We will not be held liable for damage or personal injury to individuals or their property. The BUYER expressly agrees to indemnify and save Shafer Auction Co. Ltd., the Seller and their assigns harmless from and against all claims, losses, expenses, damage or liability, directly or indirectly caused by or resulting from an act, including an act of negligence or omissions Shafer Auction Co. Ltd., or anyone acting in his/her behalf in connection with or arising out of the auction, preview or purchase pickup process. All bidders/buyers must be of legal age. RESERVE: Occasionally an item is sold subject to reserve bid. For items sold with a "reserve", a minimum bid amount is required in order to win the item. SOFT CLOSE: For online only sales, Items close at regular intervals. To prevent a bidder from "sniping", all bids made in the last minute of the auction will force an item to stay open for an additional 2 minutes. This will continue until all bidding has ceased. STRATEGY: Bidding is similar to "Ebay" type auctions, we recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment. Bidders will find the "Max Bid" function helpful when tracking multiple lots. On occasion, a bid may seem like it has advanced and skipped several bids; this can occur because other registered bidders are also using the "Max Bid" function on the same lot. This is normal process. CATALOGUE ERRORS & OMISSIONS: If a description does not match a picture in a lot, the description takes precedence. All items are sold on an "as is, where is" basis, with all faults. In the event an item was listed in error or an item can't be located during pick up for any reason, the bidder agrees that their maximum recourse is a full refund of the item in question (only) and that all bids on any other items remain binding. The bidder acknowledges that an auction site is a potentially dangerous place. Persons attending the auction sale site before, during and after the sale acknowledge that they are there at their own risk. No claims whatsoever shall be made against the auctioneer, their agents, employees, principals or affiliates for any loss, injury or damages incurred.
