Auction Terms & Conditions
Registration
- Auction registrants hereby indemnify and hold harmless the auctioneer and seller from any and all damages, claims or liabilities from injuries to persons or property of any type whatsoever caused during the sale or by the removal or shipping of items purchased.
- Auction participation is restricted to individuals aged 18 or older. By registering for this auction, you agree to be bound by it’s terms and conditions.
Payment
- Payments by E-tranfer only. Exact cash accepted if you ask prior to pickup.
Bidding
- All bids are final
- All of our auctions have a soft close.
Fees and Premiums
- A 16% buyer's premium will be added to every item sold. This covers the cost of auctions.
Pickup
- It is the bidder's responsibility to ensure they are able to remove items during the auctions pickup periods.
- No items will be picked up until all items are paid for in full.
- All items are to be picked up during normal pick up times designated by each auction. Items not picked up during that time will be subject to forfeiture with no refund. Items will be resold, disposed of, or donated.
Shipping
- Each auction and lots have different shipping fees and conditions may apply. If in doubt, contact us prior to bidding.
- Auction registrant is solely responsible for paying shipping and customs fees.
- Shipping has an additional handling fee of $5 per box to be shipped (e.g., 5 boxes x $5 handling fee, $25 would be added to the final invoice)
Item Condition and Descriptions
- All items are sold "As Is" and “where is,” with no warranties, expressed or implied.
- While descriptions are believed to be accurate, Trovato nor seller make any warranty or guarantee, expressed or implied. Trovato, it's auctioneers, or it's parent organization shall not be held responsible for advertising discrepancies or inaccuracies.

- Condition Accuracy: Trovato strives to provide accurate item descriptions and photographs. However, the description always takes precedence over images in cases of discrepancy.
- Condition Categories:
- New (Contents Sealed): Item contents are sealed, though packaging may have been opened for inspection.
- New (Open Box): Item is new but has been removed from the packaging.
- New (See Notes): Item is new but may have notes indicating minor defects or missing components.
- Used (Like New): Item appears lightly used or used once and may or may not include original packaging.
- Used: Item shows normal usage and functionality.
- Used (See Notes): Item shows normal usage but includes additional notes (e.g., scratches, scuffs, or minor defects).
- Salvage: Item is sold for parts or repair and may not function as intended.
Inspection Responsibility: It is the buyer’s responsibility to read item descriptions carefully.
Refunds
- Customers must email [ciao@trovato.ca](mailto:ciao@trovato.ca) with the subject line “Refund request” within 24 hours of receiving the item (either by pickup or confirmed delivery). Refunds are considered if the item’s condition does not match the description (e.g., listed as “New Open Box” but found to be used). Shipping fees are non-refundable.
Liability
- Auction registrants assume full responsibility and liability for any individuals they authorize to pick up items on their behalf. This includes any damages, injuries, or incidents that may occur during pickup. The registrant must notify us in advance of any authorized representatives.
Errors
- Any Announcements made on day of sale supersede all printed material. Trovato reserves the right to reject the bid of anyone who is not a registered bidder.
- Trovato shall have no responsibility for internet bidding interruption or delays beyond control. Internet bidders be aware that due to the nature of the internet, delays in transmission could result in the auctioneer failing to recognize your bid. Trovato will work to accommodate varying internet speeds but is not responsible for the final result of delays.
Disputes
- These Terms and Conditions are governed by the laws of Ontario, Canada.
Resolution: Disputes shall be resolved exclusively at the discretion of Trovato.
Amendments
- Trovato reserves the right to update these Terms and Conditions at any time, with changes effective immediately upon publication.
