Auction lots are sold to the highest bidder with a 20% buyers premium added to the final bid price and 7% Florida sales tax. There is a 3% cash discount if paid in cash and picked up onsite within the stated time frame.
Everything is sold "as is, where is" with no guarantees of any kind. Buyers shall rely on their own inspection and information and are strongly encouraged to preview items Bidders are strongly encouraged to complete an in person inspection of items during preview windows and/or prior to placing bids.
When you become the winning bidder at auction you have effected a contract and will be expected to pay for the items in which you were evidenced to be the successful bidder. Auctioneer will not honor "mistakes." All sales are final. The items become the sole responsibility of the winning bidder at the end of the auction. Kennedy Brothers shall be entitled to any attorney's fees incurred in the enforcement of this contract or the enforcement of Sell/Buy Agreement.
All transactions are to abide by the Laws and Rules of Uniform Code of the state in which the sale is held. If State Sales Tax must be collected by State Law, you will be required to pay such taxes. If tax exempt, a tax exempt form is required (NO EXCEPTIONS).
The Auctioneer reserves the right to accept bids in any increment he feels is in the best interest of his client, the consignor. The Auctioneer reserves the right to reject bidding of any person whose conduct, actions, or adverse comments he feels is not in the best interests of the consignor.
Items are not to be removed from the aution house until invoice(s) are settled. Do not move merchandise without auction staff present to check you out. Auction Company is not responsible for lost, stolen or damaged property. Lots must be removed from the auction site within one week of final payment. If not claimed, the auction company has the right to remedy, move and store at owner's expense.
Firearms:
Kennedy Brother Auctions observes all Federal, state and local gun laws. Only the registered bidder may pay for and pick up firearm(s) after the mandatory three-day waiting period (excluding weekends and legal holidays), if applicable. DO NOT, UNDER ANY CIRCUMSTANCES, PURCHASE A FIREARM FOR ANOTHER PERSON. Kennedy Brothers Auctions may, at its discretion, refuse a bid for any reason.
Local Pickup: Licensed Gun Dealer Colt's Ballistic Logistics, LLC, charges a nominal processing fee or all handguns. Firearm sales to Florida residents (with the exception of muzzle loaders or antique arms manufactured before 1898) will be subject to and must pass the FDLE Background Check. The purchaser will be required to fill out ATF Form 4473 and provide a valid government-issued photo identification.
Out of State buyers: Kennedy Brothers Auction will ship only to a Licensed Gun Dealer FFL holder in the destination state. Note that the FFL holder you sent the package to will only release the firearm to the recipient once they complete ATF Form 4473 and the National Instant Criminal Background Check System (NICS).
You must be 18 years old to purchase rifles or shotguns, and 21 years old to purchase a handgun. You must be 18 to purchase long gun ammunition and age 21 to purchase handgun ammunition. You are responsible for knowing if your state bars a certain type of firearm/ammo/accessory from being shipped to you. Know your laws BEFORE bidding. Do not bid on a firearm if — by judgment or disability — you may not legally possess a firearm. Any attempt to circumvent federal, state or local laws governing firearm sales will be reported to law enforcement and the local ATF field office.
