Terms and Conditions
Registered bidders agree to all terms and conditions set forth by Auction House 282.
All items are sold as is, where is, no guarantees expressed or implied. All information is provided from sources believed to be reliable; However, no guarantee is made or expressed by the auction company owners, nor the sellers. Bidders/Buyers shall make final determination and satisfy themselves as to size, value and all other conditions, etc., prior to auction day. *All items sold "AS IS, WHERE IS" with all faults.
Bidder inspection is encouraged, or you may ask the auctioneer (message to auctioneer selection on catalogue). By placing a bid, the bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them.
Auction House 282 Staff Reserve the right to reject any bid at their sole discretion. For internet-only auctions, AH282 reserves the right to cancel and/or reopen the auction in the case of system failures.
All bids are legal and binding, and when a buyer bids, they accept all conditions stated herein. Once the items are sold, and at the end of the auction, bidders are expected to pay within the same day of the auction upon receipt of the invoices. Bidders accept condition as viewed in the detailed pictures, in the absence of a condition description or additional report describing any flaws or less than perfect condition analysis. Bidders cannot rescind or reduce their bids. All sales are final - no refunds or returns for any reason/s to include shipping charges. Any changes to this agreement will be on a case-by-case basis and approved by the Auctioneer only. All announcements made during the day of auction take precedence over previous messages or announcements.
The Auction Company Staff, agents and/or representatives reserve the right to bid on behalf of themselves, or a 3rd party, Absentee Bid etc. pre-approved by the auctioneer. CONSIGNORS will be banned if caught bidding up their own consigned items (we do not allow consignors or staff to bid up items or on their own items).
Auction House 282 reserves the right to remove and or add items at any time prior to and/or during the auction. Auction House 282 reserves the right to refuse or deny services to anyone but does not discriminate by race, religion, or any personal beliefs or affiliations. Auction House 282 reserves the right to sell all items as preferred by the Auctioneer. Ownership of all items is transferred once the Auction ends and/or is sold by the Auctioneer. Once item/s are sold, AH282 is not responsible for damages, lost or stolen items to include damages/ or losses during shipping. All items that are shipped are insured with tracking.
ALL (INITIAL) INVOICES MUST BE PAID AT THE CLOSE OF THE AUCTION. SHIPPING INVOICES WILL BE SENT ONCE YOUR ORDER IS PROCESSED, AND MUST BE PAID WITHIN 48 HOURS OF RECEIPT OF INVOICE. WE DO NOT HOLD ITEMS AFTER 48 HOURS OF BEING PROCESSED. ALL INVOICES THAT GO UNPAID WILL BE CONSIDERED ABANDONED AFTER 48 HOURS. UNPAID INVOICES/ ORDERS MAY INCUR HOLDING OR STORAGE FEES, RESTOCKING FEES, AND OTHER FEES FOR ANY ADDITIONAL WORK NEEDED RE-ORGANIZING YOUR ORDER FOR SHIPMENT (IF APPROVED BY THE AUCTIONEER) OUTSIDE OF SCHEDULED PICKUP TIMES. ALL ABANDONED ITEMS WILL BE DISPOSED OF, DONATED OR RESOLD TO RECOUP ANY UNPAID FEES AT THE DISCRETION OF THE AUCTIONEER.
All winning bids will incur a 15% buyer's premium, plus an additional 3% for credit/debit card use. Auction House 282 reserves the right to charge customers and/or invoices immediately upon invoice at the end of auction, with the card provided during the registration process.
Picking Up:
Payments are due immediately following the Auction. NO EXCEPTIONS. Pick up is firm for Tuesday during the week following the auction ONLY. When making payment for items you won, please request a time between 10 a.m. and 5 p.m. for one of those days and we will either text or email confirming your requested time. There is a 15-minute spacing for appointments and we will be able to process 2 pickups every 15 minutes. Please make sure you make contact if you are running late for your scheduled pickup time. If you do not or cannot make your appointment within 15 minutes of the scheduled appointment, and do not make contact, your order will be changed to shipping- No exceptions. We may not be available outside of the scheduled appointment times. You will be sent a second invoice for shipping once your order is processed. When you bid, you agree to the TUESDAY pick up day by appointment and the conditions explained herein.
NOTICE TO ALL LOCAL BIDDERS- CALLING OR MESSAGING WHEN YOU WILL ARRIVE TO PICK UP IS NOT AN APPROVED APPOINTMENT. WE HAVE TO APPROVE ALL APPOINTMENTS FCFS (FIRST COME FIRST SERVE) AVAILABILITY. IF YOU REQUEST A TIME, WE WILL BE INCONTACT EITHER BY TEXT OR EMAIL WITH THE NEXT AVAILABLE APPOINTMENT (OR CONFIRMING) AND WILL NEED A RESPONSE WITHIN A REASONABLE AMOUNT OF TIME, WITHIN THE SAME BUSINESS DAY OR YOUR SLOT MAY BE FILLED.
AH282 message to bidders; We understand that things pop up and life happens. We will always do our best to work with customers. If another appointment slot is available, we may be able to reschedule within those 2 days, so long as the appointment time is available. We will have to approve ALL appointments.
*If you purchase any fragile items and/or large lots, please bring your own packing material and boxes when picking up those items. We cannot supply boxes or packaging.
*Any Items not picked up by the close of business Wednesday and invoices for shipping that go unpaid for 48 hours following the auction will be deemed abandoned. There are No Refunds for abandoned items.
Bidders are responsible for asking and retrieving all items they purchase unless shipping is involved. Please verify with your list before leaving that you have all items that were purchased during the auction. For example, if your item has many pieces, or a key, the customer is responsible for asking for those items that may be safely stored. We will not pay for shipping for items left behind.
No load out (Auction House Staff loading your items) should be expected but may be provided as a courtesy. PLEASE plan and BRING HELP for loading what you buy. We have very limited staff with limited mobility.
AUCTION HOUSE 282 AND ITS STAFF IS/ARE NOT RESPONSIBLE FOR DAMAGES OR INJURIES DURING LOADING WHETHER OR NOT WE ARE ASSISTING. NO EXCEPTIONS. YOU ATTEND, ENTER, AND LOAD AT YOUR OWN RISK. AH282 IS NOT RESPONSIBLE FOR INJURY/ OR ACCIDENTS.
SHIPPING:
All shipping orders are professionally packed in-house to keep costs lower for our customers. Shipping invoices are sent separate from Auction invoices. You agree to abide with the shipping terms when you register for any Auction House 282 HiBid auction.
Most oversized items can be shipped, approved by Auctioneer. Approval will be given with the understanding that shipping costs may increase due to proper packing, building of boxes and bracing, additional materials, size and weight of the entire order. Bidders are expected to pay for ALL their won items, even if they choose to abandon items. There is a 2-week minimum processing for items in this category, but we may be able to process faster depending on the auction.
Common items not shippable unless approved with the understanding explained above are as follows: shelf units, large furniture, heavy OVERSIZED tools, oversized appliances, Neon Lights or fragile items, and anything that does not fit in standard shipping boxes etc. If you MUST have your items shipped and AH282 agrees to ship, AH282 is not responsible for costs, damage, lost and/or stolen packages being shipped. The bidder who wants item(s) shipped takes sole and total risk in items being shipped. All packages are insured for cost, TRACKING AND INSURANCE FOR THOSE APPROVED ITEMS IS MANDATORY AS PER OUR POLICY AND FOR YOUR PROTECTION. This means NO DISPUTING, REFUNDS, EXCHANGES OR TRADES ARE ACCEPTED FOR ANY REASON- NO EXCEPTIONS. If you are unsure if the item you are looking at is oversized, please contact Auction House 282 before bidding.
IN STATE BUYERS please put "Shipping needed" in the notes to the auctioneer or email Auction House 282 if you cannot pick up. The shipping invoice can be a minimum of 2 weeks for processing and will be sent within 30 days of the end of the auction. When payment is made within 48 hours of the shipping invoice being sent, or buyers' card being charged, you will receive a copy of your invoice with the tracking information provided within that email.
*Emails, messages, and/or voicemails asking about shipping may not be responded to immediately. All information on shipping is listed herein. Email is the best form of communication DURING NORMAL BUSINESS HOURS please.
If there is ever an issue, please allow AH282 time to investigate any matter so that we may respond appropriately. Your conduct matters, all customers are treated with dignity and respect, and we would appreciate the same. Any form of unprofessionalism may result in banning from the establishment and future auctions, regardless of status of the auction.
Example: Any forms of badgering, threats, or intimidation will result in immediate banning from future auctions without refund or exchange if their are fees involved. Example: Bidder pays late, and Auctioneer approved items to be shipped outside of scheduled period but buyer refuses to pay additional fees accrued for additional work and holding/ storage fees, pulling and/or restocking fees. All fees must be paid and cleared through the bank before your items are shipped. If fees are not paid, your items will be considered abandoned and resold to recoup the costs.

Once payment is received, the buyer MUST choose to either have the items shipped or picked up at location requesting a time. If an item is to be shipped the buyer will pay all costs associated including but not limited to insurance, shipping and handling, materials needed etc. Auction House 282 will ship all items through USPS / UPS, or cheapest method at their discretion. There are no refunds, disputes or exchanges for ANY and ALL items being shipped. Any disputes are to be made between the customer and the shipping service being provided if necessary, and we will always assist with the information needed. Your packages are insured. Of course we will always correct OUR mistakes.
In the event you refuse to pay for, or abandon any item that you win at auction, Auction House 282 will have the option of reselling, removing, storing, or disposing of the unpaid or abandoned item. You understand and agree that you will be personally responsible for all deficiencies including all legal, collection, transportation, and storage expenses associated with your delinquent account and/or abandoned items. In the event of resale, you agree to pay any cost associated with the resale as well as any deficiency between your original purchase price and the resale price. Explanation: if an item is left unpaid, and resold for cheaper, you may be charged for the difference. Auction House 282 is not responsible for any deficiencies or misunderstandings or additional costs regarding all items auctioned. Terms and Conditions are provided prior to or during registration.
Any claim or controversy out of or relating to these Terms and Conditions, or to any breach thereof, will be settled either (A) in Local Kansas nearest to Auction House 282, Small Claims Court, if the claim in question amounts to less than $5,000, or (B) by means of arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association, if the claim in question amounts to more than $5,000. In the event of arbitration, judgments upon the award rendered by the arbitrator may be entered by any court having jurisdiction. You agree that all claims will be litigated or arbitrated on an individual basis and will not be consolidated with any claim made by another party. Venue in every case will be in Washington County, Kansas or another Courthouse within the vicinity of Hillsboro, KS. You agree that any judgments awarded may be applied to and collected from you personally or corporately. Should any party file an action contrary to this paragraph, the counterparty may recover reasonable legal fees and costs. Further, if you bring a claim against the Auctioneer and do not prevail, you agree that you will reimburse the Auctioneer for all reasonable legal fees and costs associated with to include damages and loss of sales and storage fees.
In all cases, the Auctioneer's liability, and the liability of the seller of the items in this auction, will be limited to the refund of your purchase price unless the item was shipped. In this case, there are no refunds for any reason regarding any shipped items to include return shipping or costs associated with shipping. The Auctioneer will not be liable for any amount in connection with the postponement or cancellation of this auction, or the withdrawal of any item or lot from this auction. In no event will the Auctioneer be liable for lost profits or any special, incidental, or consequential damage arising out of or in connection with this auction or any related sale or transaction. (A) No Liability for the Acts of Third Parties: The Auctioneer is not responsible for any action taken by any seller, bidder, or other third party before, during, or after this auction. (B) No Liability for Site Malfunction: You understand that this auction is online-only, and so relies on devices and programs that may malfunction without warning. You agree that the Auctioneer will not be liable for any error or inconvenience that may be the result of such a malfunction. You further understand and agree that the Auctioneer may void or suspend any sale, or resell any item, if the Auctioneer determines a transaction to have been affected by any site malfunction. The buyer or bidder who registered is responsible for paying for any costs, bids or items won.
You agree to indemnify, defend, and hold harmless the Auctioneer and its employees, officers, owners, affiliates, agents, and representatives from and against any claims, losses, damages, liabilities, judgments, fees, costs, and expenses, including reasonable legal fees and costs, related to, arising from, or associated with you, your agents or representatives including, but not limited to, personal injury or property damage caused at any sales site or during removal or transportation of items won at auction, any dispute with another bidder, or any violation of these Terms and Conditions.
If any term, provision, paragraph, condition, or other portion of this agreement, or the application of these, to any person, place, or circumstance, is held to be invalid, unenforceable, or void, the remainder of this agreement and such term, provision, covenant or condition as applied to other persons, places and circumstances will remain in full force and effect.
At the time of a bid placed, that shows agreement to all terms herein.
Additional Terms and Conditions for consignment agreement with Auction House 282
In addition to the terms and conditions for the sales of consigned items which also are to be recognized, here are some additional conditions that apply to the consignors. By signing, bidding and or registering for the auction, you agree to all terms and conditions applied herein.
Consignors: All items you want to consign are your property and you acknowledge that at any time any item/s is/are found as stolen property, counterfeit or not authentic (as described) you will refund the entire amount of sold price and any fees charged by Auction House 282 will be forfeited. You are solely responsible for all items including costs associated with or arising from the sale at our facility, including additional work, time and travel, damage etc. This includes the return shipping costs. This is to prevent the likelihood of items making it through our auctions that should not be sold and to ensure everyone is following the law. Those who consign and or buy with Auction House 282 are solely responsible for any issues that may arise other than the legal hiring and auctioning of all consigned items.
Representation of Genuineness.
Explanation: The sale of counterfeit items is against the law. We appreciate everyone being fair and taking responsibility for the items they wish to consign. If items are found by the auctioneer and or their staff as to be "fake" and mistakenly sold as genuine such as fake turquoise, stones, coins, jewelry markings, Autographs etc. and are "good copies" but found to be fake, the consignor should not profit from the sale and the buyer should be able to bid confidently knowing they will be refunded.
NOTE: The consignor will only be obligated to give the refund if the item is returned in the condition it was sold. Buyer or Bidder cannot damage the item i.e. Scratch, burn, rip, poke, alter, disfigure, acid test damaging surface or otherwise. Proof of inauthenticity by a professional will be required, for example, if a certified jeweler or dealer deems the item as fake, proof is needed. We cannot just take your word for it. While we do know a lot about many things, we are not experts on everything. We will always assist as much as possible to best accommodate our customers.
Consignor represents and warrants each item to be genuine. Consignor agrees that any item found to be non-genuine and listed as genuine, within 30 days of shipping label date or the end of sale date for pick-ups, will be returned to the auction house & consignor, and upon the safe return, consignor will pay AH282 the net proceeds of the returned item/s and forfeit any fees earned from the sale. Consignor will be held responsible for the costs of the item being tested (with proof from the bidder, i.e. receipt) if results are found to be fake.
Consignor understands that all items you are consigning are genuine and are to be considered as such at auction. Any sale cancelled due to any items being fake, faux, copies, fraudulent, incorrectly labeled or stamped or hallmarked, and or counterfeit and sold as genuine within 30 days of shipping label date or sale date for pickups, are to be legally cancelled and all money earned from the sale will be returned to AH282 immediately. If Auction House 282 still has money associated with your auction, it will be deducted from sales earned and voided. AH282 and the auctioneer will still earn their fees from the work involved and sale percentages associated with the auction. Refusal to refund as stated will result in the likeliness and possibility of being pursued in small claims court by AH282 and the Buyer of said counterfeit item/s. The Consignor is the person signing this document who accepts responsibility of all fees arising from court and any legal representation processes resulting in the seeking of refunds or costs associated with the sale of non-authentic items when found in favor of AH282 OR said buyer.
Disputes for Fake or Faux items Process explained. The Auction Company/ Auctioneer is the hired agent conducting the auction of CONSIGNED items. By bidding, you agree that the Auctioneer and the Auction Company will not be liable for ANY disputes resulting from (explanations, errors, flaws, damage, authentication, genuineness, accidental or missing information) regarding any items sold at auction in store or online. Any legal or other disputes will be handled between consignors and buyers only. Auction Company and staff are there to assist only. Results from any claim will not affect earnings or fees from services provided by the Auction Company.
RETURN PROCESS OF ITEMS CLAIMED AS FAKE OR COUNTERFEIT.
There will be professional testing of all items returned. Once tested and results are returned, the results will be provided to the buyer and consignor. No refund will be provided if the item is found to be authentic or found as other than the condition it was sold. This prevents stones and/or items being swapped and returned as fake because of buyer's remorse. If found later that an item was returned as fake and was authentic there will not be a refund of the item and or the money paid. If found that items are being swapped and or stolen AH282 WILL PROSECUTE as the law allows.
Once an item is received or returned to the possession of Auction House 282, the buyer understands that it may take up to two weeks or more to get results. If found counterfeit as claimed only then will the buyer be refunded and only when the consignor returns the money to AH282. Auction House 282 is not responsible for paying the refund, the consignor is. If buyer of counterfeit item decides to pursue legal representation to claim their refund, with proper documentation AH282 will have the legal right to provide this and the signing consignors information to the proper authorities.
SIMPLY STATED: AUCTION HOUSE 282 is not responsible for paying you back, the consignor is. If the consignor doesn't pay, you have the legal right to pursue them to get your money. We are here only to help and assist in getting your money back just like we are only hired as the agent making the sale at an auction. Our documents will be provided for you to use and assist in your getting your money back.
DON'TS: Your conduct matters. Using foul language, being disrespectful, or anything other than professional communication and mannerisms will result in immediate banning from our establishment. If found to be too difficult to work with, AH282 reserves the right to back out from interaction and assist in the process of getting your refund. We will not tolerate unprofessionalism.
AH282 is not responsible for lost and/or stolen items in the return mail process. The buyer will provide a return shipping label and/or all costs associated with returning the item/s and will be refunded only when or if the item is found to be non-authentic. Simply claiming an item to be fake or counterfeit does not guarantee a refund.
Example of the description items that may be returned: Sterling Silver ring with genuine turquoise stone.
Description of items that cannot be returned: VTG Sterling Silver ring, Size 9- Untested/ Sold as shown.
Explanation: Some items are easily identifiable and come with documentation while others do not. Some jewelry can be made and are very good fakes that even professionals miss from time to time. We do not allow the sale of fake items and do our best to prevent the sale of any fake items. We will do our part, and ask that all involved in the auction process, by this agreement on both ends keep their end of the agreement. If not, all parties have the laws and rights available to use when necessary. Auction House 282 will always assist the buyer when items are found to be fake and will provide all signed documents to ensure the best possible chances of said buyers getting money that is rightfully theirs.
NOTICE: There will be a trusted professional testing all returned items. Once results are returned, the results will be provided to the buyer and seller, and no refund will be provided unless the item is found to be in original sold condition and results show as faux or fake. NO REFUNDS FOR BUYERS' REMORSE.

Pick-up will be on Tuesday immediately following the close of the auction from 10am-5pm.

Appointments must be made for pickup prior to Tuesday with a paid in full invoice.
Shipping is available for this auction. Auction House 282 cannot ship large or oversized items. Please read terms and conditions for shipping information. It states that shipping is available on all items, but please understand the items stated in the Terms and Conditions are not shippable. Auction is marked as shipping offered on all lots.
Shipping cost will be included on a second invoice once the buyer notifies Auction House 282 that they will need their items shipped. We will always include shipping for out of state buyers, so you must notify us if you will be picking up the item. If you are in state and require shipping, please notify us by responding to your invoice email.

If you do not pick up on Tuesday as required, your invoice will automatically change to shipping and your items will be shipped to you (as long as they are deemed shippable items as explained in the Terms and Conditions).
Items will be shipped as quickly as possible, but please note that all items will be shipped out within 30 days of the end of the auction with successful payment.
