Shipping
Buyer Pays Shipping Cost. All items will be taken to the UPS Store for shipping. You may contact them with any questions concerning shipping at (352) 377-6840. They will contact you separately with an invoice for shipping. Buyers receive their shipment tracking information once their items ship. Customers will make shipping payments directly to the 3rd party provider. Please allow up to 14 business days after receipt of payment for your purchases to ship. Adams Enterprises assumes no responsibility for lost or damaged items received through the shipper. All shipping damage/loss claims must be processed and resolved through the organization by which they were shipped.
Pick Up
We will dedicate and post a local pick-up day at the completion of the auction Pick-up is available at our Auction House and items need to be picked up within 5 days of auction. If prior arrangements have not been made, items left after 5 days will accrue a $10 per day storage fee. All items must be paid in full within 3 business days of auction. The auction house reserves the right to hold the merchandise until the funds have cleared. Any item that is paid for yet not picked up or shipped within 15 days of the auction will become the property of the auction house.
Sales Tax
Online purchases from Adams Enterprises may be subject to sales tax. If you are tax-exempt, you can submit your tax-exempt certificate to prevent the collection of tax.
Terms
Online Absentee Bidding only *You Must Be 18 Years Old to Register to Bid *Registering to Bid Requires a Valid Credit Card. The card you submit when registering for each auction will be charged at the conclusion of that auction to Include the Price of the Winning Lot, 20% Buyers Premium, and 7.5% Sales Tax when Applicable. *To Verify a credit card there will be a $1 surcharge to the Card but the $1 will fall off the account within 5-7 days
20% Buyer's Premium. 7.5% Sales Tax. All items are sold as is and all sales are final. Items are sold AS IS, WHERE IS, and buyers are encouraged to make their own opinions as to the condition of an item. Any condition statement or estimate is given as a courtesy and is only an opinion and should not be treated as a statement of fact. The absence of a condition statement does not imply that the item is in perfect condition or completely free from wear and tear, imperfections, or any damage. All sales are final, no refunds and no returns.
Limits of Liability. In no event shall Adams Enterprises, its owners or employee’s liability to Buyer exceed the purchase price actually paid for an individual item or lot. A Buyer's claim shall be limited to the amount paid for the merchandise, and shall not extend to any obligation, risk, liability, right, claim, remedy for loss of use, revenue or profit, liability of Buyer to any third party, personal injury, or any other direct, indirect, incidental or consequential damages. Buyer further acknowledges that each item it purchases at the sale represents a separate transaction and that no one transaction shall be conditioned upon another transaction. Buyer hereby holds Adams Enterprises harmless from (a) the acts or omission of any party who provided any items to Adams Enterprises for sale, (b) the acts or omission of the owner or Lessor of the auction site or the site where the auctioned items are stored, (c) any claims Buyer may have against Adams Enterprises, Adams Enterprises’ client(s) or any former owner of the property being sold, (d) Buyer's failure in any way to properly inspect items and/or fulfill its obligations per the terms and conditions of the sale, as indicated within this document or as announced by Adams Enterprises at the time of sale. In the event Buyer provides a deposit or payment using a Credit Card, Buyer acknowledges that it is purchasing under the As-Is, Where-Is terms of the auction and that Buyer shall waive all rights of charge back based on any claims of misrepresentation, non-delivery, or non-performance. Indemnification. Buyer shall indemnify, hold harmless, and defend Adams Enterprises, owners, and building owners from and against any and all losses, damages, liabilities, and claims, including attorney fees, costs, and expenses arising out of any disputes.
We attempt to describe and identify all items, it is the Buyer's responsibility to research and verify all items.
No Credit Card Chargebacks. YOU agree that such YOU will not, under any circumstances, initiate a credit card chargeback with respect to any purchases at the Auction. YOU further agree that if, in violation of these Terms and Conditions, a credit card chargeback is initiated, these Bidder Terms and Conditions will be conclusive evidence of YOUR agreement not to initiate a credit card chargeback; and YOU acknowledge and agree that on the presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution that issued the credit card on which charges were made, such bank, credit card company, or other financial institution will reverse or deny any credit card chargeback, and will re-credit all amounts to or for the account of Auctioneer. If, in violation of these Bidder Terms and Conditions, YOU initiate a credit card chargeback, even if successful, YOU will remain liable for all purchases made at the Auction, and YOU will be responsible for all costs and expenses, including attorneys' fees, incurred by or on behalf of Auctioneer and/or any Seller(s) in challenging the credit card chargeback and in collecting payment. YOUR agreement not to initiate a credit card chargeback is a condition to YOUR Registration as a Bidder, and for the privilege of bidding at the Auction, and is being made as an inducement for Auctioneer to accept YOUR Registration and to permit YOU to bid at the Auction. The auctioneer is relying on YOUR agreement not to initiate a credit card chargeback for accepting YOUR bidder registration and permitting YOU to bid at the auction.
