TERMS:
Possession will be given at closing.
All announcements made day of the auction from the auction block take precedent over printed or electronically produced media.
Real Estate Taxes and Closing Cost: All real estate taxes will be prorated for (year). The purchaser will pay all other closing costs associated with the purchaser's side of the sale, including local and state recording fees and any cost associated with the purchaser's loan. The seller will pay for deed preparation and deed tax.
Real Estate Earnest Money:
Conventional Loan Buyers:
10% down payment day of sale, with the balance of purchase price due within or upon 30 days of date of auction. Payment to be in the form of cash, cashier's check or verified funds.
Owner Financing Buyers:
20% down payment day of sale, with the balance of purchase price due within or upon 30 days of date of auction. Payment to be in the form of cash, cashier's check or verified funds.
This Auction is not contingent on or subject to financing, appraisal, survey, or inspections of any kind, as agreed to by bidders at registration prior to bidding. If the buyer is obtaining conventional financing please speak with your lender to ensure the loan can be completed by the specified closing date before bidding.
Seller and Buyer(s) shall pay their share of the costs of closing. The buyer acknowledges they are buying property "as-is", "where-is", without inspections or contingencies. The buyer(s) will rely on his/her own judgment and inspection ALL SALES ARE FINAL! The bidder understands and agrees that no refunds, exchanges, adjustments, chargebacks, etc., will be allowed. Property is available for inspection at specified times, and it is the bidder's responsibility to determine the condition. Bidder's failure to inspect any item or lot will not constitute grounds for any claim, refund, adjustment, chargeback, etc.

Buyer and or Bidder agrees to hold harmless and indemnify Americana Real Estate & Auction and its Agents and its Representatives from any and all claims, damages, or suits including but not limited to awards, judgements, costs, fees, etc.
