Software & Server Technical Issues Swenson's Auctions is not responsible for any technical difficulties related to the server, software, or any other online auction related technologies. Swenson's Auctions reserves the right to resolve any bidding dispute by extending bidding, continue bidding, or closing the bidding. Neither Swenson's Auctions nor any company providing the software shall be held responsible for missed bids, or the failure of any software to function properly for any reason. No Reserve All lots will sell to the highest bidder without reserve. No Buybacks All consignors are prohibited from bidding on lots they have consigned to the auction. Buyer's Premium A buyer's premium of ten percent (10%) of the high bid will be added to the high bid to determine the price for the auction lot. Tax The current rate for Big Horn County, Wyoming is 5 percent (5%). The total high bid, including the buyer's premium rate, will be added to determine the final selling price for the auction lot. Regardless of buyer's state residency tax will be applied, unless Tax Exempt number is provided to Swenson's Auctions. Payment After sale concludes, winning bidders will receive a call from a Swenson's Auctions Representative confirming payment type. If no contact has been made by 12:00 P.M. on pickup day, your card on file will be automatically charged. A 3% surcharge fee will be added to invoice totals on ALL credit card purchases. All buyers must pay for their purchases in full 24 hours after auction ends. No items can be removed until payment has been received by Auction Company. Swenson's Auctions accepts the following forms of payment: Cash, Cashier's Check, Personal or Company Checks and Credit Cards. Merchandise becomes the full responsibility of the buyer at time of payment and the buyer assumes all risk of loss and damage to property at that time. Swenson's Auctions reserves the right to resell any property not paid for in full by the conclusion of the stated pickup period. In any such event, the Buyer will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting from the resale of the property. Inspection Dates and Times All personal property in this auction is available for inspection on location according to the schedule below. Buyers are responsible for rigging, loading, and moving all items purchased without assistance from Swenson's Auctions, However an auction employee will help find items. Bring your own MAN POWER!!! Items will not be released unless a PAID receipt, digital or hard copy, is present. Shipping Shipping IS ONLY AVAILABLE if the shipping Icon is on the lot. Swenson's Auctions will then transfer items to a 3rd party shipper upon request. We are selective of the items we agree to transfer/ship, We use a 3rd Party Shipping Outlet for most items. Swenson's Auctions will charge a $5.00 handling fee per lot for transfering items to the shipping outlet. The Shipping outlet we use is UPS in Cody WY. Swenson's Auctions suggests that potential buyers contact the the UPS shipping outlet in Cody WY @ (307) 527-6980 to inquire about potential shipping costs before bidding. Once the items are packed ready to ship BY UPS they will contact you directly to arrange payment. Some lots may be grouped together so that a bid on one lot will extend the time on all lots in that group. Debt Collection and Interest Charges The buyer agrees to pay all reasonable attorney fees and other costs incurred by Swenson's Auctions in its efforts to collect unpaid funds from the buyer. The buyer agrees that a fee of 2% of the outstanding balance per month be added to any unpaid balance due Swenson's Auctions. Any debt collection or dispute proceedings will be heard in Park County, Wyoming. Pickup Date(s) All items must be removed by either Thursday, December 5th or Friday, December 6th, 2024, 8AM-5PM, UNLESS PRIOR ARRANGEMENTS HAVE BEEN MADE, NO LATE PICKUP AVAILABLE!!! Limitation of Liability If, for any reason, Swenson's Auctions is unable to make available or deliver any Purchase, or portion thereof, or documentation required in respect of any Purchase, the sole liability of Swenson's Auctions, if any, shall be the return of monies paid in respect of such Purchase upon its return by Purchaser. Age Requirement All bidders must be 18 years of age or older. Bidder information and Security All registration information the bidder provides to Swenson's Auctions shall be current, complete and accurate. All bidders are responsible for any bids placed under their bidding numbers and passwords. The security of bidder information is the responsibility of the bidder. Bidders must notify Swenson's Auctions if they believe that their bidder number and password have been compromised. Tie Bid or Uncertainty In the event of a TIE BID or any uncertainty as to offered last and highest bid the Auctioneer has a right to resolve any such at the time by accepting the Bid that the Auctioneer believes is in good faith and was the last, highest and best bid. Auctioneer may open the bidding between the parties at his discretion and option and such decision will be final and binding on affected parties.
