Description
Patriot Wholesale is proud to offer our estate sale of a selection of items. We plan on hosting more auctions in the near future. This auction offers items that can be picked up in person or some can also be shipped for a small fee. Auctions include: glassware, artwork, figurines, porcelain, ceramic, pottery, vintage, antiques, collectibles, plates, glasses, mugs, kitchen, decor and more.
By registering for this auction, you agree to the following terms and conditions. This is a legal binding contract between you, referred to as the “Bidder” and Patriot Wholesale Direct LLC referred to as the “Auction House”. 1. Item Condition: All items are sold “AS-IS” and “WHERE-IS”. The Auction House does not guarantee the condition or functionality of any items. Descriptions provided are for informational purposes only and are not guaranteed to be accurate. The Bidder accepts responsibility for inspecting items during preview days. It is the bidder's responsibility to determine the condition and suitability of each lot. The Auction House is not liable for any issues related to broken or damaged items once they are sold. 2. Buyer’s Premium and Sales Tax: A buyer’s premium of 18% will be added to the final sale price of each item. Additionally, Michigan's 6% sales tax applies unless a valid sales tax license is provided before the auction's closure. Our estate sale auctions will not incur Michigan’s sales tax per Michigan law. 3. Inspection/Preview Day: Bidders are encouraged to inspect items during preview periods. The Auction House does not offer refunds, returns, or discounts for dissatisfaction with items post-purchase regardless of reasoning. Please contact us by calling 248-481-7083 or by email at Sales@PatriotWholesaleDirect.com to set up a preview time. We’re typically available Monday – Friday from 10am to 5pm. Please have the lot numbers you would like to view ready. You may also request a video, additional pictures or a Facetime appointment. The bidder is responsible for any damage done to lots while previewing the lots. 4. Lot Removal: The Auction House reserves the right to remove any items or lots, even after bids have been placed, without notice. 5. Auction Closing: The auction follows staggered and soft closing methods to ensure fairness. The Auction House may also host live online auctions (simulcast auctions) or on multiple bid platforms, which could adjust the time intervals between lot closures. 6. Payment: The bidder will make full payment for all items won at auction close. The credit card on file with HiBid will be charged shortly after the auction has concluded. If the card on file is declined the Auction House will charge a $2 decline fee and a payment e-mail will be sent and must be paid within 24 hours. If payment is not received, the Auction House will take legal action and will leave negative feedback. After 48 hours of no payment, the Bidder agrees that the items won are considered abandoned and will be returned to the Auction House, however, the bidder is still responsible for the full payment. 7. Shipping: The Auction House does provide shipping on some lots (although not all lots). The Auction House will assume all items planned to be picked up in person unless the bidder lets the Auction House know that they would like the item shipped. The Bidder must contact us by the end of the pick-up times to set up shipping, otherwise the lots will be considered abandoned and will return to the Auction House with no refunds. The Auction House primarily uses USPS, UPS and Freight services for shipping of lots. The Auction House will only charge the actual shipping costs (using discounted services) plus the cost of packaging and shipping material. Insurance is optional and may be added for an additional fee. The bidder agrees that they’re responsible for all damages that occur during shipment and will not hold the Auction House responsible. The Auction House will only ship to the address on file with HiBid. 8. Removal: The Bidder agrees to pick up all items on time within scheduled removal dates of that specific auction unless other arrangements have been made. No items can be picked up unless the Auction House has been paid in full. The Bidder agrees that if the items are not picked up by the end of the pickup window a $5 per day, per lot fee will be charged for 5 days. After 5 days the items are considered abandoned and will go back to the Auction House. The Auction House reserves the right to determine the method of disposal, which may or may not consist of waste disposal, resale or donation. The bidder is responsible for all removal and loading of the winning items. The Auction House may help with loading, if available, however they may decline to help in the removal process. If Auction House staff assist with loading, they are not liable for any damage to items or property or to any damage caused to property or vehicles of the Bidder. The bidder is responsible for any damaged caused to the items and/or the Auction House property during the removal process. The Auction House recommends that the bidder brings help to load larger, heavy and/or bulky items and to bring any packaging material for safe transport. The bidder agrees not to hold the Auction House responsible for any personal injury to the Bidder while on-site at the Auction House location. 9. Retail Items: Barcodes/UPC may be slashed through after photos to ensure an item can’t be returned. The bidder agrees not to return the items to any retail business. 10. Technical Errors/Bidding Errors: In the event there are technical difficulties related to the server, software, internet or any other online auction-related technologies, the Auction House reserves the right to pause bidding, extend bidding, continue the bidding, or close the bidding. In the event you have made an error bidding, the Bidder must contact the Auction House immediately. Bidding errors cannot be fixed after the bidding has closed on those items. If you have made a bidding error on the last day of the auction, we may not be able to fix those issues as we may not see your request before the auction closes. In the event we cannot fix those issues on the last day of the auction, you will be responsible to pay your invoice amount. In the event there is a malfunction within the software and/or bidding the Auction Houses is using, the Bidder will not hold the Auction House accountable. 11. E-Mail and Text Permission: By signing up for our auction, you give permission to the Auction House to add your name to the mailing list for both e-mail and text messaging communications. You may unsubscribe at any time. 12. Legal Recourse: Disputes must be settled through binding arbitration rather than ligation in Oakland County, Michigan. Bidders are responsible for all mediation costs. The Auction House will use all legal means necessary, including small claims court, to recover unpaid invoices or fees. The Bidder is responsible for all fees incurred in our attempt to retrieve money owed including, but not limited to, attorney fees, court costs, our time on a per hour basis, etc. 13. Modifications to Terms: These Terms and Conditions can be changed at any time without notice by the Auction House.
