AUCTION TERMS & CONDITIONS: A Buyer's participation in this auction is an acknowledgement and acceptance to all Terms & Conditions outlined, along with the protocols outlined in the Bidding and Auction Notices for Two Five Auctions. BUYER PREMIUM: Buyer Premium of 18% plus Ontario HST will be applied to each invoice for all winning Bids. ALL SALES ARE FINAL. NO REFUNDS, NO EXCHANGES, ALL ITEMS SOLD AS IS WHERE IS. WITH NO WARRANTY. Please note details in the Lot descriptions, we have consignors that list both new and used merchandise. There are no real or implied warranties on any items; everything is "SOLD AS IS." REVIEWING YOUR BIDS: During an active auction you can check the status of your bids at any time. Note that no bids can be withdrawn after the auction for any reason. All items are sold as is, where is, with any deficiencies. BIDDING NOTIFICATIONS: You can choose to be notified by e-mail during the auction if you have been outbid. Please note that outbid notifications are NOT sent out during the last two hours of the sale. The method and procedure of any auction on the Website is at the sole discretion of Two Five Auctions. By placing an online bid, Buyers agree that they are satisfied with description and photos, and/or have waived rights to inspect further. Two Five Auctions reserves the right to reject any bid, at any time and without reason or explanation. WINNING NOTIFICATION & INVOICING: All winning bidders will receive an e-mail with an attached invoice from Two Five Auctions the morning following the auction close. PAYMENT FOR YOUR ITEMS: There is no cost to register for an auction. When an auction closes, you will be notified if you are the winner. We will request an e-transfer payment for balance owed; winning bid amount, plus applicable Buyers Premium and taxes, as stated in terms of auction. Payments are accepted exclusively through e-transfer. Credit cards on file will be only be charged if E-transfer is not received on the due date. An additional processing fee will be added to any orders paid with credit card. Items not paid for in full, claimed, or picked up, in accordance with the terms and conditions of sale and within the scheduled pick up times, will be considered abandoned and resold in a future auction sale without notice. Any deposits on hand will be forfeited and non-complying buyers/bidders will be blacklisted on future auction sales. All items must be paid for by 11am on the day following the auction. . PICK UP SCHEDULE: Purchases will only be dispensed when proof of paid invoice is provided. The winning bidders are responsible for arranging and adhering to agreed pick-up time. We do not ship. Do not bid if you are unable to have your items picked up during our hours of business. Pick up for the items shall be at the expense, liability, and risk of the purchaser. Please note that there will be no support staff available to help transport items to your vehicle. It is recommended that you bring help if you purchased large or heavy items. Upon delivery, we are not responsible for items that were forgotten or left behind. Be sure to verify all items before you leave pick up area. The purchaser will not be entitled to possession of any Lot purchased from Two Five Auctions until the total purchase price of the Lot, any other items and any outstanding invoices (due to Two Five Auctions) have been fully paid. In the event that Buyers fail to pay the full purchased price for any lot(s) within the prescribed time, or fail to comply with any of the "Terms of Sale", they may be sent to collections and/or sued in the Small Claims Court. In addition, any paid amount for previous invoices and Lots (by the purchaser and not in their possession) will be treated as a deposit towards outstanding invoices without notice. If Buyer abandons or fails to pick up during the specified times, Two Five Auctions shall not be held responsible and shall add a surcharge of $25 added to cost and/or sell to recover storage costs. All bidders/buyers must be of legal age. RESERVE: If an item is being sold with a reserve, it will be clearly marked and identified. For items sold with a 'reserve', Buyers will be required to pay a minimum amount in order, to secure the item. All items that are offered by auction may be subject to a reserve or opening bid, which is the confidential minimum price acceptable to the sellers. AUCTION RECORDS: In the unlikely event of a dispute, Buyers agree to accept the information that we have in our records, as the legitimate transcript & confirmation. The highest bidder acknowledged by Two Five Auctions will be the purchaser. In the event of any dispute between bidders or in the event of doubt on our part as to the validity of any bid, we will have the final discretion to determine the successful bidder, cancel the sale or to re-offer and resell the article in dispute. If any dispute arises after the sale, our sales record is conclusive. SOFT CLOSE: Items close at regular intervals. To prevent a bidder from 'sniping', all bids made in the last minute of the auction will force an item to stay open for an additional 3 minutes. This will continue until all bidding has ceased. Most of our auction lots close in 10 second intervals. In other words, if an auction has 100 lots and is scheduled to close at 8:00 p.m., the first lot will close at 8:00 pm (soft close in effect) while the 100th lot will close at approx. 9:16 p.m. (soft close in effect). STRATEGY: We recommend that ALL BIDDERS put in their maximum bid when placing a bid online. This does not mean you will have to pay the amount you bid; you only pay one bid more than the next highest bid, and only up to your maximum bid. The software system will play out the bids as you would at a live auction and only uses the funds required to beat out the under-bidder at the prescribed bid increment.
