ASSOCIATED AUCTIONEERS INC. VEHICLE ARBITRATION POLICY (BUYER) Defects, conditions, or discrepancies described in the policy may be eligible for arbitration if: 1. The vehicle is paid in full 2. The defect, condition, or discrepancy was not disclosed or announced at the time of sale 3. Minimum bid price of $2,000 on vehicles sold to the public, and $2500 on vehicles sold to dealers 4. The request for arbitration is made within the arbitration period described in this policy, and vehicles must be returned to Associated Auctioneers in the same or better condition than when purchased. 5. If one or more of the following is suspected: a) Cracked block b) Bad transmission c) Incorrect odometer reading d) Frame damage e) Carfax discrepancy Arbitration Period: The arbitration period during which the buyer may request arbitration for specified conditions and defects is two (2) business days following the auction. Arbitration Fee: A $200.00 + HST arbitration fee is payable by the buyer to Associated Auctioneers. In the event the Associated Auctioneers' arbitrator finds, in his sole discretion, that the arbitration request is without merit, the fee is non-refundable. If the arbitrator finds, in his sole discretion, that the seller has not met all of the disclosed obligations set out in this policy with respect to the arbitration request, the buyer will be refunded the fee and the seller will be charged the arbitration fee and any awarded price adjustment, is applicable. Each arbitration request must be properly documented in writing by the buyer. It is the buyer's responsibility to satisfy itself with a vehicle's condition, to read and listen to announced conditions before placing bids. Once the vehicle is sold, the buyer should check the auction contract to confirm the vehicle price and announcements are correct before signing the auction contract. Once the vehicle is paid in full, the buyer should thoroughly check and, if possible, test-drive every vehicle purchased. If there is any problem, the buyer must request arbitration within the applicable arbitration time limit noted above. The buyer assumes full responsibility for mechanical or electrical failure once the arbitration period is over. The buyer, buyer's designee, or buyer's agent (e.g. transporter or driver) should note and obvious damage on the gate release prior to removing the vehicle from the auction facility. Buyer may not arbitrate any obvious damage not identified on the gate release or the condition report once the vehicle is removed from the auction facility. A WORD OF WARNING: The arbitration process is not a tool for price reduction or for dealing with "Buyer's remorse". Terms and Conditions - To bid and buy REGISTRATION & IDENTIFICATION: At the time of registration, we collect information about you to verify who you are before you can bid. We collect credit card information to ensure that you are a qualified buyer. All bidders must be of legal age to bid. PAYING FOR YOUR PURCHASES: There is no cost to register for an auction. Bids on vehicles are subject to seller approval. If a bid is accepted the winning bidder will receive an phone call from McKenzie's Associated Auctioneers. A deposit is required of $500 if the vehicle is sold. Vehicles must be paid in full by 4 pm Thursday (the day after the sale). (Cash, Debit, E-transfer, or Certified Cheque.) TERMS FOR NON-PAYMENT: All bids are final and accepted as offers. If you are the winning bidder and your bid is accepted, payment is due. If payment is not made, the sale will be cancelled and you will be responsible for a $200 administration fee, the buyers fees, and the sellers fees for the sale. You will also lose your deposit. The total amount due will be sent to collections. REVIEWING YOUR BIDS: During an auction you can check the status of your bids at anytime.
