Round Top Auction Terms & Conditions
Welcome this auction is presented by Round Top Auction. By registering or bidding you agree, unequivocally and without any exception, to all of the terms and conditions, including announcements or corrections made prior to the auction. You must be 18 years old to register and bid at the Auction.
Auctioneer reserves the right to approve your bid(s) and may ask for a 25% refundable deposit. We accept bids from live bidders, online bidders, phone or written bids.
Buyers Premium: 25% (live, in person) or 30% (online) is in effect for all items and will be added to your invoice. We will also add sales tax to your invoice at the rate of 8.25% unless you provide a valid active resale certificate.
Forms of Payment: Cash is United States dollar, Credit cards: Visa, Mastercard, Discover, American Express. We will also accept Bank wire transfers. All bank wire transfer fees will be paid by the buyer. All purchases over $3000 will require a Bank wire transfer. We will accept checks with prior approval.
In-Person Pick up and Collection of Items:

You will have 10 15 days after the auction to remove your items from this location once your item has been made. We will bring your item(s) to the loading dock. It is your responsibility to load and secure your items. Items will incur a storage fee after the 15 days: Fee $50 plus $10 per day. If for any reason you fail to pick up your purchase it will be considered abandoned, and you will forfeit your paid purchase, and it will be re-auctioned. We cannot store any paid items or unpaid items. RoundTop Auction will not be responsible for any claims after 15 days. Please contact Round Top Auction if there is a concern.

Representations: All items are being sold AS-IS with no warranty. The auctioneer shall not be responsible for any incorrect therewith, authenticity, genuineness of or defect in any lot and makes no warranty in connection therewith. Auctioneer makes every effort to provide accurate information about the items being sold. Auctioneer is solely acting as an auction broker. Errors may occur, either written or verbal. It is the buyers? responsibility to confirm the accuracy of items offered for auction. INSPECTION IS HIGHLY RECOMMENDED to satisfy any questions. It is the sole responsibility of the buyer to inspect each item regardless of whether it is online or live in person bidding.
All lots offered are sold "AS IS"
All Sales are Final. All successful bids constitute a legally binding contract of sale and are final. There are NO refunds, returns or exchanges.
Registration does not guarantee bidding privileges. We reserve the right to remove or restrict bidding privileges. In the Great State of Texas, a winning bid constitutes a legal agreement of payment. We reserve the right to permanently ban all non-payment bidders.
Acts of Others: Persons in attendance, during inspections, or removal of merchandise assume all risks of Damage or loss to persons, property, or merchandise. You shall exercise proper precautions at all times for the protection of persons and property and shall comply with all safety and health requirements as directed by the auctioneer. Neither the Auctioneer, subcontractors, its agents, its employees, or representatives, shall be liable by reason of any defect in or about the condition of the premises on which the auction is held. Buyer specifically releases Auctioneer, and its agent, its representatives from all liability Thereof.
INDEMNIFICATION: Buyer Shall Indemnify, Hold Harmless And Defend Auctioneer, Owners And Building Owners From And Against Any And All Losses, Damages, Liabilities And Claims, Including Attorney Fees, Costs And Expenses Arising Out Of Based Upon Or Resulting From: (1) Failure To Secure All Safety Equipment And To Meet All Applicable Government Safety Standards In Removing Items Purchased Or Used By Buyer, (2) Failure To Comply With Safety Instructions Issued To Buyer From Auctioneer, (3) Any Act Or Omission Of Auctioneer, Owners, Building Owners Or Their Respective Agents, Representatives Or Employees, Relating To Or Affecting The Items Bid On Or Purchased By Buyer, (4) The Claim Of Any Third Party Claiming Or Challenging Title To Any Items Purchased By Buyer Or Claiming Infringement Of Any Proprietary Interest, (5) The Claim Of Any Person Resulting From Auctioneer Offering For Sale Or Selling The Items Purchased By Buyer, (6) Any Injury To Buyer Or Any Other Person Or Property Of Any Type Whatsoever Caused During The Inspection, Dismantling, Removing Or Transporting Of Items Purchased By Buyer.
Errors: We Reserve the Sole Right to Settle Any Dispute or Tie Bids Between Bidders. In The Event of a Live/Online Error We Reserve the Sole Right to Cancel Any Winning Bid. Internet errors occur, auctioneer reserves the right to correct internet errors, including reoffering a lot.

Auction Is Conducted with A Reserve. We reserve the right to pass any item. RT Auction, auctioneer, or employees or subcontractors may place bids.
Collusion: Practices to eliminate competition, such as collusive bidding with the intent to not pay, drive invalid bids may warrant criminal, civil or administrative action against the participant(s) and may referrer to the seller and the State Attorney General Office. Online fraud is a Felony.
Inventory may change or be deleted at the will of the Auctioneer.
