He’s been used as a lesson horse and on play dates. He is a one of a kind and gets along with everyone. He’s easy to catch and loves attention. Would make someone a good ranch hand. Pick up for all horses is by the end of day on Sunday. If you need to make arrangements for your horse to stay longer while you make transportation arrangements, please contact the office on Sunday. We can board your horse until Friday following the sale. Unfortunately we do not have the room to board your horse any longer. Board fees will apply at $10/day per head. Any livestock leaving the state of Washington must have a health certificate to cross state lines. Horses must have a health certificate and a negative coggins before crossing state lines. These tests are the buyer's responsibility, ESP will help get the test done. Enumclaw Sales Pavilion, its associates and the auctioneers’ function is to bring the buyer and seller together. All responsibilities and guarantees lie between seller and buyer. Please remember that every bid you place is a binding contract. You are agreeing to buy the item(s) at the price you indicate should you ultimately be the high bidder. Bids may not be canceled once submitted. If you accidentally enter a wrong bid amount (for example, you entered $1000 instead of $100) you can click on the Cancel link within the bid confirmation pop-up window to change your bid amount prior to submission. Changing your mind does not qualify as accidentally entering a wrong bid amount. If you place the bid, you may win the item, if this happens you are obligated to pay for the item. You are agreeing to pay and take your animal/item during pick up times. Sold as is, Where is: When you place your bid you are accepting that the animal/item is sold with all existing faults, imperfections, and its current condition without any warranties or representations. Your bids affect how other users bid within the auction and the auction's final selling price. We provide ample opportunity for you to check and double check your bid before submitting, so requests to cancel bids will most likely result in the suspension of your account. LIABILITY - Buyers and spectators are cautioned to be careful while on the grounds and particularly while horses are being shown or sold. All persons attending the sale do so at their own risk. Neither the owners nor any other person connected with sale assume any liability, legal or otherwise, for accidents of person or property, before, during or after the sale. No one is allowed to enter into a horse's pen without the seller's permission. ESP is an equine facility and all actions and activities are subject to the Equine Inherent Law. By your presence on these grounds, you have indicated that you have accepted the limits of liability resulting from inherent risk of equine activities. We are regulated by the WSDA and USDA. Horses ENTERING OR LEAVING our State are REQUIRED by law to have a coggins and health certificate. No coggins test is necessary if you are staying within Washington State. Horses are not permitted to leave the facility until all required paperwork is in order. It is the responsibility of the buyer to complete all necessary paperwork for out of state travel. ESP can arrange for a coggins and health certificate to be done by a local veterinarian at the buyer’s expense. They are typically done the Monday following the sale and the paperwork is usually back and ready for the horse to leave the Thursday or Friday following the sale. Buyers will be charged $10/day board fee until the horse leaves the facility. All horses will sell AS IS. All guarantees are made between buyer and seller. In the event of any dispute all information in our possession as to address and telephone numbers will be provided to both parties. *Buyers do your due diligence*. The buyer is the responsible party to examine horses carefully before they bid. Limited Warranties: The seller is the responsible party for all representations or warranties, expressed or implied concerning the condition of any horse and buyers should satisfy themselves concerning the condition of any animal they purchase. Except as otherwise announced by the auctioneer at the time of sale. The consignor of each animal represents warrants to the buyer and ESP, the following: Title of the animal is free from all adverse claims to ownership, use of possession. The animal is sound of eye and wind. The animal is not a ”Cribber,” Wind Sucker,” have “Heaves,” or a “Weaver.” The animal has not been nerved. The sex or conditions as a gelding or ridgeling is as described as a colt and does not apply to any horse sold prior to Dec. 31 of his yearling year. All mares that have been spayed must be so stated. The animal is not deaf. If any of these conditions is announced the consignor is held harmless for the condition WITHOUT WARRANTY AND WITH ALL FAULTS. Every horse is sold under this rule; therefore, no horse can be rejected by the buyer when struck off by the auctioneer, except in the event one of the above conditions is not announced by the seller in the sale ring. There is no guarantee of any horse sold in this sale except when the owners makes a specific guarantee. In such case right of recourse must be directed to the seller. In the event of any dispute all information in our possession as to address and telephone numbers will be provided to both parties. TRANSFERS: buyers shall be responsible for all association transfer fees. Do not alter transfer forms an forward all transfer forms to the proper association when making transfer. Title to and right of loss passes to the buyer when the animal is announced sold by the auctioneer. Immediately after the horse is sold and leaves the sale ring, it will be the sold risk and responsibility of the buyer. Effective from the time of purchase the buyer assumes responsibility for the maintenance and care of the animals. The buyer further agrees to indemnity and hold the consignor and ESP, harmless from all loss, cost and expense arising from the illness, injury or death of such animal or loss or damage to property and injury or death of persons caused by the buyer, the buyer’s agent or employees, or by the animal subsequent to the time of purchase. In order for you to leave with your horse, you must have a PAID in full receipt. You must check out with ESP staff. Horses must be gone by end of sale day unless arrangements have been made with the office. Horses that are boarded here are left at buyer’s risk. PAYMENT: Payment for your horse(s) and tack will be due by the end of the sale, NO EXCEPTIONS. ONLINE BIDDERS: your card on file will be charged for the full amount plus a 4% CC fee will be applied. We accept cash, debit, and credit (4% CC fee will be applied). We do NOT accept checks. NOTICE TO ALL BUYERS: You will need to contact your bank to let them know you will be making a large purchase. Most banks will put a limit on how much you can spend in a day. Banks are not open on Sunday so you will need to call during banking business hours to ensure your charge is approved. FAILURE TO PAY: Failure to pay for your horse(s) and/or tack will result in your ability to purchase from us in the future. Any horse not paid for by the end of the auction is considered abandoned and will become the property of ESP. Buyer remains responsible for the invoice balance due on their purchase(s). If payment is not made ESP will mitigate their losses (resell the purchase(s)) and the buyer who abandoned their purchase will be liable for the difference in invoice prices. There will be no pre-bidding. Bidding - Bidding will happen live in our facility beginning at 1pm and online. You will be able to watch the auction as it happens from your home and bid from home if you choose to.
